I just double checked the claim form and realised i accidentally put-

I can't see the fact i accidentally put customer service in as well gives them grounds to argue its not properly served as the legal entity and address are the same!
I will need to give the court a quick ring as they have only sent a judgement form in my name and i assume the other two claimants need to also fill it in (three claimants on one claim).
I am right to think once I send the judgement form in a CCJ is issued and they cannot then argue about it?

Not really - or at least, that would be optimistic. They'll probably apply for a set aside, claiming the papers were not served properly. And the courts, who seem to dislike default judgements, will probably grant it.0 -
I successfully had a pay out from Virgin last year and am trying to help some friends who were on the flight with us. They are further back in their claim and have so far got a reply back from their NBA, stating the usual refusal to pay.
I have advised them to sit tight and wait for the Huzar outcome. Just wondering if they should still get the MCOL done anyway? If they have it in place, then if the Huzar is law after the supreme court, then at least they will be in a better position to proceed rather than being at the back of the queue.
The flight was oct 2008 so the deadline is looming. To clarify, the 6 year deadline, is that to put a claim in to the airline or to put a claim in via the court (ie MCOL)?? Thanks all0 -
The 6 year threshold is for a court claim to be submitted after the delay. What date in October? Bear in mind October 1st is only a day away! If they wait for Huzar they will be (well) out of time.0

Not sure if they have to do MCOL or Form N1, I did MCOL for me and my spouse and 2 children, but have been reading bits on here that it should be N1 for families?

N1 to Salford (if you are dealing with a family) but you really need to get a move on as time is not on your side. Application has to be 100% correct and not leave Virgin any opportunity to have it rejected.0 -
Hi, just thought I would update re my claim with Easyjet.
Court served the papers which were returned marked 'return to sender'. As 14 days passed and there was no response I filled in the judgement form. Last week we received our CCJ of approx £1420 :T They have been given until the 29 Oct to pay. If they don't I will send the bailiffs round.
Not sure if that is their strategy as most of their CCJ's are still listed as not satisfied so maybe they don't pay unless they are enforced :think::j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j:j0
