cash back problem dilemma - advice please?

I have an 02 12 month contract phone from an online supplier. They give cash back installments as per many of the deals. The problem is that each monthly bill balance goes up because they never take the direct debit. This month it will reach 12 months (£360). There is definitely a direct debit set up (i've checked and it was a condition of the contract), i've called 02 twice and they still do not take the money. Each bill says at the bottom that i do not need to take any payment action and the balance will be taken by direct debit.
My Online supplier will not give me cashback because my bill payments are not up to date but it is not my fault that O2 do not take my payments. I'm just about to end my contract and i haven't been able to claim the cash back. This doesn't matter because i have nothing to claim back as i haven't actually paid anything, but what happens if 02 suddenly ask for the money when the contact ends? It would be totally unfair if they asked for the money because they have stopped me getting the cash back. I therefore think i should pay my tarrif minus the cash back i was entitled to = nothing! What do people think i should do?

    you need to ring them and pay your bill has it will affect your credit rating ,cash back is from the people you got the phone from not O2.
    O2 will ask you for the money one day, where your fault or not and it will not be a nice letter
    there or their,one day i might us the right one ,until then tuff

    I'm not sure if uve read my post properly - I have rang them. The contract is direct debit only - it's not my fault that they don't take the money!
    I know the cash back is from the phone supplier, that's what i've put in my post. Not sure how your reply helps me.
    It appears to me that under cashback rules, if the network supplier is just 1 month behind on their direct debit requests you are then behind on your payments and the supplier does not give you cashback. Its totally outside the customers control!

    i think it will be hard for you to get anything back via cashback, as most suppliers will need you to be up to date with you bill (ie: owe the mobile comp nothing).

    u will need to call 02 up, and and try and sort things out. Its better to pay up before they get a debt collection agency to harass you. why did you not call them up when they failed to take the first dd payment? had you done that 12 months ago, you probably will be able to get your cashbacks.

    i have to say, chaces of you getting back your cashback is almost zero. BUt , you will have to pay 02 up. the sooner you pay up, the less interest payment on the amount due.

    The 1st bill was sent immediately so i wouldn't know that the money hadn't been taken till the 2nd bill. I rang at the 2nd bill to tell O2 that they had not taken the money from the 1st bill. They told me that it was because DD takes a month to set up and the 1st 2 payments would be shown as taken on the 3rd bill. When i got the 3rd bill they hadn't taken it. I rang them again and they said they would sort it. Month 9 and still no joy so i sent them a letter but no reply. You cant be certain that a phone call every month would have sorted it! Ive now got bill 11 and i'm cancelling my contract for the end of month 12. It would have been impossible for me to do something 12 months ago because the 1st time i knew for certain they were failing to take the DD having had time to set it up was when i recieved the 3rd bill (9 months ago). I've made the phone calls, sent a letter - I cant make them take the money! My bank confirms that may DD is active and O2 have never claimed. As i said in my previous post, the network provider appear to be able to force people to fall foul of the phone suppliers cashback get out clauses (by mistake or otherwise) because the customer has no control over the provider to make them take the DD.

    you can ring them and pay the bill or take the bill to a O2 shop and pay there , just explain what has happen and get a receipt for you bill,that your saying about the DD is right then you have had the mick taken out off you long enougth now by O2 . it's time to sort it, not your fault put your responsible for it, i now it's not fair ,you really do need to pay that bill ,you need to speek to a manager at O2 to sort it .
    please sort the bill
