offer accepted, house still advertised on rightmove!

We recently had an offer accepted on a property we wish to buy. It is on with 3 agents, mainly because the vendor apparently would not accept an offer below 190. As we are in a good position he has (got fed up of waiting??) now accepted our lower offer. However it is still on Rightmove with the other two agents although it is listed as under offer with the agent we offered through. Why is this? Please no harsh replies, we are not experts and would genuinely like to know the answer to this as our agent is not very forthcoming. Is it like a repossession where they can continue to market it up to exchange?

    DO NOT WORRY!!! It is incredibly common for the internet sites to still be advertising a house, after an offer has been made, and even after completion in some cases! Although the individual estate agents usually remove them.... after completion....We went with an estate agent some 4 years back, who turned out to be useless, so we moved to another one, and six months AFTER we left, the house was still up for sale with that original estate agent LOL.

    Also, the estate agent will still have it 'on the books' and on their website, and 'should' have it flagged up as 'sold subject to contract.' I have never known an estate agent just completely take it off their books, as if it never existed.

    If you have made an offer and it has been accepted, then the estate agent will tell people that there is an offer on the house, but they may take details from people, in case the sale falls through and they have some interested parties to fall back on; and they will certainly keep it on their property list, until the sale is completed.

    So don't worry. If your offer has been accepted, then it's yours as long as you do not pull out and nothing goes wrong (like your mortgage failing or the buyer pulling out of your house (if you are selling...)

    The other agents can keep it as for sale, they will not show the property to anyone. The usual practice is for them to take the names and contact numbers of anyone who contacts them and make contact again if your sale falls through.

    It is unlikely that anyone would accept a higher offer once yours has been agreed. They would have to pull out of the sale, causing penalties and problems for them....

    What about if the vendor has accepted our offer but listed the property with new EA a few weeks later? What do you think his intention is?

    To be blunt....get a higher offer!

    Assume you havent swopped solicitors details etc yet then?
    Never, under any circumstances, take a sleeping pill and a laxative on the same night.

    When our offer was accepted for our house (completing next week), a condition of us offering the full asking price was that the estate agent was to take it off the market within 48 hours. They agreed and the next day it was taken off right move. It was still on their own website, but was displayed as SOLD subject to contract. The for sale sign outside the house was also changed to sold.

    You should perhaps speak to the estate agent. It is not unknown for a late offer to come in and for someone to lose a property. I guess it comes down to how professional the estate is.

    As I said just politely speak to them. If your finances are in place and you can show them proof of funds then they may be more likely to do as you ask. We were asked for proof of funds and had no issues showing it to them.

    Thx-our Solitcitor has already received a draft contract from their solicitor. What we are waiting for now is to send surveyor in. We have already have mortgage approved.

    We have also agreeded to be exchanged/completed by end of May. Because they have listed with a new EA we r puting our surveyor on hold as we don't want to lose more money on this.

    We have spoken to our EA but no respond from the vendor yet.

    This is the second time that someone pulling out on us after offer accepted and started the search/sent surveyor. We don't want this happened to us again. It is so hard to find a property in London!

    The EA I am buying from refused to put STC on RightMove for a long time - they kept making excuses.

    Although the EA must tell anybody that enquires about the property that it is under offer, they also have a duty of care to the vendor (their client) to let them know that there has been interest.

    There is an element of the integrity of the EA as to whether they will still show people around the property if the vendor still wants them to. And if they are holding out for a higher offer, then they will try to keep as many avenues open as possible.

    I would suggest that you contact the EAs associated with the property and politely tell them that they must show it as STC on RM. This will help to diminish any risk of being gazumped, though unfortunately until exchange, there is still a possibility that your offer could be beaten...
