@colino - Yup, to be honest wasnt sure where else to get advice from after being told by this second hand dealer we got it valued by that there was a high risk mark on it and they wouldnt touch it, i thought others, such as car craft etc, would follow suit, so tried CAB.

well it wasnt quite myself who made the original dealer aware, as the place where we took it to get valued got the experian check done, and then phoned him themselves to see what the problem without me knowing - I then assumed i was just trying to track down a finance company, which in fact turned out to be the original garage that sold it.

I appreciate what you are saying about not passing the problem on. I'm just a bit cheesed off that all of a sudden ive got this mess to sort out when i bought the vehicle in good faith and all i want to do now is get rid and part exchange it. Like i said, even if i did pass the problem on, no doubt it would come back to haunt me so its not something i'd like to do!

@worried - if i sell it privately though and then that person finds out about this marker eventually wont it then just become my problem again anyways? I do feel a bit aggrieved though that others have owned it privately and basically just got rid without any repercussions and then all of a sudden im lumbered with it.

I think you are going round in circles after you have had the best advice,

Get the dealer you bought it from to sort it

The dealer you bought it from will also be an innocent party, like youself they had good title and were entitled to sell it. The car can be bought and sold but just because a garage doesn't want it for trade in purposes because of it's history doesn't mean it can't still be sold elsewhere.

Your best bet is to put pressure on experian who have the marker on it and tell them as an innocent puchaser the cars new history means it should be removed.

CAB are not entirely useless but the advice they gave you was wrong, the dealer you bought it from was perfectly entitled to sell a car they had good title to, you have no claim against them.

According to point 5.1 of the CCTA code of practice: 'members should afford innocent purchasers of vehicles, that are a subject to a Bill of Sale, the same protection under the Hire-Purchase Act 1964 Part III - "Title to Motor Vehicles on Hire-Purchase or Conditional Sale", but only insofar as title shall transfer to the innocent purchaser in the event that the Member failed to register his interest in that vehicle with a relevant Asset Finance Register Company within 24 hours of execution of the agreement.' But what does that mean?Graham Haxton-Bernard, head of legal and compliance at the CCTA who drafted the code of practice, said that this translates as those who 'innocently purchase' a second-hand car in 'good faith' will gain the deeds to the car.

Hopefully this could be a step towards either clearing the black mark, or enable you to sell it on?

Get a value for the car as a part ex as if it didnt have the marker.

Then goto the dealer that sold it to you and tell him you will settle for that much and be out of his hair.

Otherwise you will drag him through the courts for selling you a car he didnt have good title to.

Then you have cash to haggle the price down on the car your buying.

You bought it, you didn't check it, you take the hit.

If you are flogging it, a 10 year old Ka, what's that worth? £3.50?

Except they bought it from a dealer who should have checked it.
