Parking eye fine...to pay or not to pay??

I received a letter from Parking eye today saying I had over stayed by 42 mins in their 3 hour stay car park. I have used this car park hundreds of times and not once have I ever noticed the 'the signage, which is clearly displayed' and was never aware of the 3 hour stay rule. This car park has 4 shops in it, Asda TKmax hobbycraft and Homebase, 2 of which I visited and having a young baby had to stop and feed during our visit.
I've seen lots of people on here saying ignore these fines as they are scammers but I worry too much about further action such as the courts or the bailiffs. I've also seen on here a few cases of where people have ignored and they have received court papers. I'm not impressed with the idea of wasting my money on a rule that I never knew existed but shud I just pay the £54 before it goes up to £90 or more?? I would go down the appeal route but I'm guessing I've not got a leg to stand on.
Any help / info would be much appreciated

    I would complain to the 2 retailers you went to and demand that they get this ticket cancelled. They are in breach of the Equality Act 2010 because your child with yourself are protected under this. But if you don't tell them they are in breach they won't know .

    I would write an email and send it directly to the head offices of these companies. I would also say to them that they are liable for the actions of their agents, and you are minded to sue them because of the harassment you are going to receive. If you scan in your receipts do that and remind them that you are a customer.

    Does this still apply if the car park is not owned by these shops and is managed by parking eye?

    Retailers have a lot of say on car parks and land they lease, if they refuse to help tell them that you are going to sue both of them, the landowner and parking company jointly. Don't be fobbed off by them, head whatever email or letter like this.

    I know somebody here got more than £300 compensation from the small claims track. But it's not about making money it's about what's right, you can always take this to the local press as well, 'mum gets parking ticket to feed her baby' will embarrass the hell out these companies.

  • Thank you so much for your help. I will defo do this and see what they have to say. To top it all I can hit Asda harder due to the fact their lift wasn't working and I had to get help carrying the pram up the stairs to get to the baby changing facilities.

    There is an option to ignore, but in this case I think a complaint will be better in this case.

    Go for it :) expect them to try and fob you off though as asda is notorious for it. Don't let them off lightly though, they have cancelled the charge and gave gift vouchers for one complaint I've seen. Also don't forget the other retailer

    Yes that is why you should try and get this cancelled with asda and the other retailer. Can I just put some context for the court cases though

    2011

    more than 1.8m fake tickets were issued
    over 600k of them were ignored and not paid
    just 849 claims were made
    and 49 went before a judge
    there was 25 wins for the motorists
    and 24 for the parking companies

    So on that 99.993 % of unpaid tickets never went to court

    Sazzy,Pretty sure the feeding baby appeal has been used before elsewhere - and Parking Eye have withdrawn the parking charge. So appeal on those grounds quoting the Equality Act 2010.
