New EU proposals for Air Passenger Rights

These are simply proposals at this stage and will probably not enter EU law until early 2015.

Any current claims for compensation for cancelled or delayed flights will be made under the existing Regulation 261/2004.

    Without going into details of the proposals i just have something i would like your opinion on:
    If a current claim keeps being rebuffed by an airline and they use delay (excuse the pun) tactics, then they appeal the claim in court until a time when the new proposals come in, would the claim then be judged under the new proposals? Or would it only ever be judged on law at the time of first going to court?

    Don't know, but it is rare for new laws to be made retrospective
