Did you have a Thomas cook flight number?

Richard - if holiday/flight was booked with TC then surely the problem/delay compensation is their problem and not Onur??

Isn't it the carrying airline that's responsible though KAB?

To be honest I'm confused as (in this case) your contract is with TC so normally if you had a delay over 3 hours you would contact them as you paid them but I presume they chartered the Onur Air plane in which case the flight would be given their flight prefix - I am not going to mention their pre-fix here as it will only confuse. Onur incidentally currently have a larger fleet than Monarch Airlines. If the plane was wet leased it would retain a Thomas Cook prefix flight number. If you required any help from the CAA they would contact the airline not the tour operator hence my confusion ~ hopefully someone will come along and enlighten me!

The claim can only be made against the operating carrier, in this case Onur. As they are Turkish and outside the EU, you can claim for a flight delay in the UK but not if it was a return flight. Whether Onur will even engage in correspondence is another matter altogther....

hi, im confused now???? the flight was ohy 6968, so assume its the onur air flight thats at fault,( but it was thomas cook that took the booking and payment ) But when we arrived and approached the travel rep ( thomas cook) she explained she, had also been waiting hours and hadnt slept!!!!!!!. ive sent an email to thomas cook but no reply as yet (10 days), hope some one can steer me in the right direction, surely thomas cook have chartered other airlines before, thanks everyone. bb

Thanks for confirming that it wasn't a wet lease.

The claim is only against Onur, you are wasting your time writing to Thomas Cooks. If your flight was from the UK, you may have a claim,if it was the return flight, you haven't. As you suggest there were Thomas Cook reps at the airport, I suspect your delay was on the way home, if it was EU261 which gives the right to claim does not apply at all
