Black Horse Finance cant find me?!

Hi all,

A few years back i successfully reclaimed by bank charges. A few friends have since reclaimed their PPI and it was only when i saw an advert to reclaim Black Horse Finanace PPI through a company that i thought id give it a go.

Having used Noddle to view my credit report i can see i had 2 loans with them, and i can see the last few digits of the account numbers. I certainly dont have any paperwork stored with these full numbers on.

I called Black Horse who have a dedicated line for PPI. I gave my name and all of my previous addresses and they said they'd write to me within 10 working days, which they did.

They say despite searches of their systems they are unable to locate a credit agreement for me with the information i have provided. Also if the account has been closed for more than 3 years (which they have) its possible my details were removed from their systems altogether.

Unless i can provide numers they wont do anything further.

Please could you advise how best to proceed?

    If you don't have records and the Bank have no records your complaint is over before it's begun. Send the bank a SAR letter to be certain...

    Today ive registered with Noddle (what a great site!) and have found the dates and last 4 digist of my 2 Black Horse Finance loans, however they are listed on Noddle as Lloyds TSB Asset Finance loans.
    I've printed out 3 copies of the 1st letter to send out requesting my information as im unsure which Black Horse address to post to, and ive also printed one to post to Lloyds PPI address (as listed in another thread).
    Do you think this is ok, or will it confuse them having 4 letters out there being researched for?

    I posted out a letter to each address I found and received responses yesterday. 1 letter basically said unless I provide account numbers they can't do anything, the other gave me account numbers AND photocopies of my original agreements - very helpful.

    My concerns are that i applied for these loans over the phone and i signed the agreements and ticked to have PPI when they posted them to me - do I have a case as I chose to add PPI...?

    Any advise appreciated :)

    Unfortunately, postal and internet applications are rarely mis-sold as no bank staff were present during the sale. It appears you mis-bought rather than were mis-sold.
    You might get lucky with an auto-payout or goodwill payment.

    Take a look at your agreements and see if you can find boxes marked (A) - (D) this is for your amount of credit (for the loan) and charges for credit.
    Can you see boxes marked (E) - (H) this is for amount of credit (for payment protection plan) and charges for credit.

    Now look down the page for Total Monthly Repayment (ie (C) + (G)) is £

    If your agreement is like this, it is single premium/ front loaded and is the most upheld of all complaints with FOS.

    My 1st loan has the lettered boxes so you think this one has a good case to claim?

    My 2nd loan also has the lettered boxes but also has a tick box to add PPI, which is ticked and i have signed. Having thought back to that time, i recall being told that i had to take out PPI to enable me to get the loan, without it they wouldnt give me the loan, i remember the bloke on the phone being quite serious about it.
    However i have signed to say that i understand that i am purchasing a product, so i guess that i dont have a case here as i cant prove otherwise?

    Your complaint is a "hearsay" one for which you can provide no proof. As you say, the Bank will point to the fact that you applied for the loan by post and that Bank staff didn't actually "sell" it to you. I doubt there is any transcript of the 'phone call you remember.

    You can still complain giving the reasons you state, but you are reliant either on the Bank's investigation turning up a different fault with your application or on getting lucky with an auto-payout.
