CMS uk @ robin park, wigan.

Date of ticket 4th october 2012, appealed the same day. They rejected the appeal 11th oct 2012. Both by e-mail.
No reference to POPLA or a verication number supplied in their reply.
I then sent them a stinker of a reply.
23.01.2013, a letter saying the amount due is now £90 with a lovely photo of my van parked on double yellows.
26.02.2013, I now owe £140 and legal proceedings will commence in 7 days unless I pay in full.
I wasn't shopping, I was in matalan asking how do I get to their delivery bay, the only person who could tell me was in the storeroom so it took over a minute but not 2.
I have to park in front of shops to a-deliver goods or b- get directions to the rear. Traffic wardens and the police understand this but not this lot.
2 days later at robin park, different delivery bay but padlocked. Phoned the number to contact security to open the gate. They replied "you'll have to go to the front of the shop and ask them to open it". No I didn't by the way.
Any advice is most welcome.

    If so they are in breach of the bpa CoP as they must either supply a popla code within 35 days of your appeal, or allow the appeal, I would put a complaint into the dvla about this

    Scan your letter in and send it to them, ask them why they have given registered keeper details to this company who are in breach of the bpa CoP ? And demand that they explain what they are going to do about it.

    Then complain to trading standards with the same thing, if you wish complain to the bpa as well , ask them what they are going to do about the illegal harassment you are having from one of their members who have broken the CoP to pursue you.

  • Yes it is that lot, they also had all my details, address etc on the 4th october.
    In their letter dated 23/01 on the back it says "we had reasonable cause to request your data from the DVLA", I fired an e-mail off saying they had my details on 4th october 2012 and had no need to contact the DVLA.
    I've kept copies of of all e-mails by the way.

    You can start ignoring them now, could have done as soon as they failed to give you a POPLA code. You only carry on appealing if you have POPLA as an option and they took that away from you. Their only other remedy would be to try to win a case in a small claim but they wouldn't have a hope in hell.

    CMS may not be there but versions of similar threatograms are.

    It's all hot air so get on with your life and stop falling for the bait. They cannot affect your credit rating and would be laughed out of small claims court if ever they actually tried, since you were effectively 'invited' to park there if delivering to the legal owner/occupier. That takes precedence because your contract was with the owner/occupier. Also their breach of the BPA code of Practice would not be viewed favourably by any County Court judge.

    Not that you will have any Court case to attend, they are as rare as hen's teeth. Just laugh at the letters and emails and stop replying right now. It ends soon, they've just spent more time on you because it's free for them to email and you keep taking them seriously and reacting - so they think they just need to push you and worry you a bit and you might fold and pay them some money. Don't! :)

  • I thought they'd given up after rejecting my appeal but they kicked off again after 3 months which I thought odd.
    I was thinking if it went to court common sense would prevail and your reply supports that.

    It won't go to court though, think about it, if they had a valid case why wait all these months and still not make a claim ? I would write to the dvla about this, they are deliberately withholding your right to use popla , so this whole thing is invalid.

    If it was me I would send a letter before action to the parking company and dca for a claim of harassment , a claim of £300 would be about right I think for the hassle you are getting. If they persist I would actually sue them. Others on here has done exactly that.

    If I get another letter I may just do that.
    The dumb thing is they replied (11/10/2012) that they understood why I was parked where I was.
