Whiplash claim

In october last year a lorry ran into the back of my car at a roundabout. The collision wrecked the tailgate and smashed the rear screen etc.
Details were exchanged and I phoned the owners who were prepared to pay for the damage without going through their insurers. They did, and sent me a cheque for an agreed amount.I was happy as the low value car would have been a write off.
After the accident I had neck and shoulder pain for a few days but didn't bother the doctors. Since then however, I have had increasing pins and needles in my arms and legs during the day, and it even wakes me up at nights.
Is it to late to lodge a claim for damages and do I need a solicitor?

    You have 3 years from the date of knowing and so easily within the time limits.

    Most would use a solicitor, especially if the other party is intending to settle privately

    doubt they will settle private for pi
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    You have not thought to seek a medical examination for the cause of these pins and Needles, but would rather just claim compensation.
    Hmm not sure that adds up and no doubt the insurance company wont neither.
    Be happy...;)

    arms and legs could be the cold weather in your joints

    I think a lot will depend on how the note enclosing the settlement cheque was couched. If it said "In full and final settlement of all claims arising out of....." then it will be much harder to obtain an additional settlement.

    But you will lose nothing in trying.

    Do you experience pain alongside the pins and needles? Is it there all the time or does it come and go?

    Have you seen your doctor? Are you taking any medication? Ask for a referral to the pain clinic

    Its a lorry so potentially a fleet policy in which case (a) they may want to settle privately for a low value PI to avoid premium loadings and (b) if its a large company may well be a captured insurer or fully fronted etc so all goes to the company until it hits the excess layers anyway

    Have you informed your insurance of this incident? If you claiming from their insurance you will need to.

    Before you get a letter from them saying they maybe charging you more or cancelling your policy for a failure to disclose important facts.

    Accidents, Incidents even where no claim has been made.
