Phone repair (long time)

My smart phone developed a fault within the first year so sent it back to buymobilephones.net for repair. They received it on 31/01/13 and a full 5 weeks later they still have it :eek: I've made 4/5 phone calls and sent 3 emails - the last one a week ago, giving them a deadline of this Wednesday(13th March) to either return it repaired or give me a new one. Which they've not replied to in any way!
During phone call 1 and 2 I was promised a loan phone. 3 weeks later after yet another call, a cheap Nokia 100 was sent to me. It's rubbish. I'm trying to set up a business so it's very frustrating, to say the least, not to have my mobile.
What can I do now? They have me by the short and curlies:mad:

    More info required, as to why there is such a delay with the repair.

    Who cares about the reason?

    If the last letter that they ignored can be considered as a letter before action, it's time just to submit a claim to online small claims court for the market value of the handset plus the inconvenience they caused.

    Quite simply because some posters post as if it is ALWAYS the other party's fault :eek:
    EG Phone lost stolen, handset sent off to recyling companies, warranty claims that perhaps are user damaged.
    Some often want a fight, yet never come back with the conclusion from the SCC or tooing and froing of correspondance.

    Yes, after 5 weeks nobody cares. They have more than enough time for either accusing the OP of damaging the handset or repairing/replacing it.

    I agree, I'm wondering if the OP has forgot to include this in the post, it does seem strange (yet not unheard of) that they have taken charge of the handset and there has been no update at all.
  • Thanks for the replies - they did take some understanding at first, as I am new to this.
    I have had no information from the phone company, other than they've sent it to their repair centre weeks ago. No updates on this, even when requested. I was told they would inform me on progress over a week ago. I'm still waiting for the call.
    Also have no idea about online or other small claims court. I'm just pigged off with getting no input whatsoever.
    Is CAB an option?

    CAB will give you advice, but are only a soothing service for irate punters - not a route to satisfaction. Despite the loaner phone being less than you would like, they have ensured continuity of service - which they are not required to provide. For this reason SC action is I'll advised, as there may be a legitimate reason for the delay - worst case scenario is they say the adult is caused by abuse and you're still no further forward.

    You are entitled to explanations, so keep pressing them - they ma feel guilty enough to resolve the issue, especially if they have lost it!
