tc delay tactics

I had a delayed flights on 20.12.2010 to las palmas from EMA
returned 26.10.2010 both legs had more than three hours delay. I claimed in January 2010 and got the fob off letter. I then got into a letter writing competition with the usal foboff
explainations. I left it in abayance pending the outcome of the ECJ ruling i then wrote again saying the appeal had been dismissed and they should pay up. Their stance is still
no compensation. The only explaination for the delay was at
las palmas when the captain came out and said it was a technical problem. I think the delay at EMA was due to crew shortages. TC have said on a number of occasions to quote
"there is absolutely no provision in EU 261/204 to pay delay compensation". I dont think they know what they are talking about I have had 8 letters from TC they are about the same as those ones posted I also note that every letter is from a different person.
There was no provisions for food or drinks. to date they have not indicated what they allege the reason for the delay was. Theyve had a LBA and Ive started the Court process off.
I have no problems with court action as I was in the past quite used to it. I have sued a number of holiday firms in the past and theve paid up before the case was due to be heard. I suspect that is what might happen now as their legal dept at Peterborough is going to be involved. I think the people in the customer relations dept dont know what they are doing and just try the "fob off" procedure. Im afraid to say it doesnt work with me im in it till the end.
