banned in Guernsey driving here

A pal of mine was banned from driving 3 years ago while living in Guernsey,he has now moved over here and is taking his uk driving test,does he have to declare the guernsey ban to his new insurance company here

  • Bit of a funny one that and depends on how the insurer regards Guernsey/Jersey. My knowledge with the companies that I've worked for is that it would be best to declare it, as either they'll say it's not notifiable or they need to know. Either way your friend can't do any harm by declaring it, whereas not doing so can really bite back down the line.
    I work for a leading insurance company as an Insurance Advisor dealing with Commercial Insurance. Feel free to ask me any questions but please do not take what I say as correct advice at all times, as every insurance company works differently to others.

    Yes, I suppose there is that risk.

    But on the other hand if he fails to declare it and they feel they should have known, there is a risk to him if they subsequently void the policy or sue him for costs they pay out to a third party under it.

    The insurer will likely ask "have you ever been banned from driving" not "have you ever been banned from driving in the UK" or words to that effect. Of course he would have to declare it unless the rehabilitation of offenders act came into play.

    Meant to add that it seems a lot of hassle unless his licence expired whilst he was banned or he was ordered to retake his test when his ban ended. If he is trying to start with a clean licence to avoid disclosure to insurers then IMO he is asking for trouble.

    But some of that does not apply.

    This is a different territory, and anyone coming here from abroad for more than a certain amount of time has to obtain a UK licence. Even Carlos Tevez.

    Did he notify his insurance company when he got banned in Guernsey?

    I ask, because most of the channel island insurance companies use UK underwriters, certainly here in Jersey they tend to use Aviva.

    As stated if asked you must declare.

    The local CAB page (Guernsey will be the same as Jersey) gives clear enough information

    When asked how long he has held his licence he will have to say x months as if he says y years, then when he sends his licence in insurers will ask about any difference. It all souns as if heis trying to hide something. Also if it was 3 years ago did he by any chance get a 3 year ban for drink driving, which I normal ban in Guernsey?

    spot on,when he got banned he then moved here to work at his sisters restaurant

    hide is not the right word really, he will declare if he has to but would rather not, if it is not relevant here

    He needs to read what the proposal form is asking in the way of questions and answer honestly disregarding where the offence was committed unless the question asks ' have you ever been disqualified in England etc. If proposal says UK for instance he wouldhave to check out that insurer's definition of UK to see if Channel Islands is included. DD is a serious offence and he will find a limited market to offer cover. As he got three years he will have been significantly over the limit.

    With this on his record, he definately does not want the complication of non-disclosure and a cancelled policy as this will have a long term impact on his ability to obtain cover. I also believe that DD has a longer term requiring disclosure under rehabilitation of offenders act but others more knowledgeable will comment I am sure.


    In addition in the event that he has an accident and he has not disclosed, then insurers have the right to invalidate the policy. If there is a claim involving a third party they will pay that element if personal injury is involved, but have the right to purse him for their outlay.


    Please encourage your friend not to commit fraud - this is not the sort of offence that he can claim to have forgotten about when he fills in his application form!
