    Why the hell haven't you tried sorting something out before now? you must have known that you didn't have the money to pay the rent months ago, why haven't you sorted your finances out? You must be living in a dream world, if you haven't a job, and you are not claiming LHA, Then you have asked for it. I would start packing, because you can't live there forever. No matter how much you think the law will protect you. I actually feel sorry for the landlord.

    I think getting your deposit back is the least of your worries. How do you expect to be able to rent anywhere else (even if you have a deposit) if you have no income? Any new landlord will want proof of your earnings etc, to grant you a tenancy. No money for rent, you will be in the exact same position with a new landlord chasing you.

    Your only option is to sort out your finances, benefits and get onto the council (as I said earlier), pretty damn quickly. You WILL be evicted for this, it will just take a little while for your clueless landlord to get his "ducks in a row" and sort out the paperwork to do it correctly. You could have a few weeks at most before he applies to court so use that time wisely, ring the people I suggested you contact earlier, stop wasting time here arguing about your deposit and rising to the bait thrown at you by other posters and sort your life out. Hiding behind the fact that your landlord doesn't know what he is doing will not help you - only you can help you!!!!!!!!

    YOU WILL NOT GET THE DEPOSIT BACK, IT IS NOW PROTECTED.

    WRONG - LATE PROTECTION DOES NOT COUNT, LATE PROTECTION MEANS DEPOSIT MUST BE RETURNED, LATE PROTECTION MEANS LANDLORD HAS FAILED TO COMPLY AND LATE PROTECTION DOES NOT RULE OUT THE CHANCE FOR TENANT TO CLAIM 1-3X PENALTY. Localism Act changed deposit rules to outlaw late protection as a LL get out clause!!!!!

    We can all shout and use pretty colours, but doesn't mean you are correct in what you are shouting!

    However, as I said earlier, landlord will claim for arrears, so best for OP to let them keep deposit and offset against what the LL can claim back.

    I'm not sure about the whole deposit thing, but I think that some of the other posters are right in that I would suggest you would benefit from making some phone calls or visits tomorrow to sort out some income and a place to live.

    Don't worry about your deposit. If you are entitled to it, then you will get it back and if not, then you won't and you'll have to worry about that later on. I am sure you are entitled to some benefits cos everyone can get something.

    You are pursuing the wrong issue, you are in breach of contract there is no excuse for this, your landlord is providing the service (roof over your head) and you are trying to sting them on the damage deposit. Go stay in a friend's or relative's spare room before the landlord ends up repossessed, don't go inflicting yourself on another unsuspecting landlord. How do you have internet connection at 9pm but not a penny to pay the rent? No wonder your landlord is angry.

    Pay your rent and the landlord will leave you alone or move out - you say 'we' have no income, this makes no sense there are numerous means tested benefits available depending on your circumstances and they can *sometimes* be backdated.

    According to the debt charities CCCS and Payplan rent, mortgage, council tax and food are your priority bills, everything else can wait. If the landlord and the council take you to court you will be in far worse financial trouble than now, you risk extra charges being added, county court judgements that will completely stuff your credit rating and make it difficult to rent another property.

    You have said its protected now so I suspect you'll not get anything back from it now.


    Read my replies above. Late protection does not count. However, tenant here is taking the mick if they think they are going to see a penny of it back!
