    So the letter stating my case is stayed pending the Dawson outcome says if my case is not re-instated by December it will be struck out.

    Does that mean if the SP date is 2015 I'll have to re-apply through the court process?

    Would have thought your case was stayed due to the outcome of the Dawson -v- Thomson appeal. That appeal has now been heard and resolved HOWEVER Thomson have now appealed to the Supreme Court (not determined yet whether the SC appeal will be permitted) so I would just 'phone the Court to ask them. There may be a 'window' for you to say the 'current' law is in my favour so please determine my case.

    Just rung the court and apparently they have received a letter from Thomson re. the SC appealthe judge has reviewed my stay and agrees it should remain. They said to write to the judge before December to extend the stay if that date drags...

    The reason the Court has done this is so that the file doesn't sit around gathering dust. When granting a stay or a general adjournment most judges will add what some call a "self-destruct order".

    EG "The case is adjourned generally with liberty to restore but if it is not restored by 30th June 2015 it shall be struck out"

    The Court of Appeal already made a decision - it found for Dawson. Do you mean the Supreme Court? If so see 111KAB's post about eight above yours!
