    Just won an appeal against ParkingEye on no GPEOL and ParkingEye failed to produce a copy of the charge and any evidence.


    To be exact, you won on PSDSU, and the assessor then didn't bother to consider GPEOL.

    Also followed all the stickies and got the same result as trisontana against CP Plus. :-)

    It took me a long while to go through all the information, digest and then write my Popla appeal. But I learned so much more about the law! So thank you to all you guys who have helped out so many here and have empowered the people to take on bullying corporates.

    Yeah, VAT is irrelevant.

    Until a Court rules once and for all that a PPC's charge is not tresspass remedy, but no GPEOL and a penalty. They should be paying VAT on penalties and back-dated will be bankrupted.

    As soon as GPEOL is mentioned the PPC is going to lose at POPLA, and it's going to cost them £27.




    If they cancel before POPLA assessment, there is no £27 loss.


    So why don't they cancel and save themselves £27??


    It's madness............. or more likely incompetence.

    Obviously, once they admit that they won't defend GPEOL at PoPLA, then they admit that they accept that they don't have one. PoPLA is based upon an independent assessors view on the day and not a legal precedent. They day they accept that GPEOL doesn't exist, the whole scam is over for good.

    VAT is irrelevant in respect of saying POPLA costs the PPC £27 + VAT ... that was the context in which the statement was made. ;)

    POPLA win against UKCPS for ticket whilst in my own space.

    "It is the Appellant’s case that the parking charge notice was issued incorrectly.
    The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
    Accordingly I have no option but to allow the appeal."
