    If he has no convictions then in theory it didn't happen. Their own guidelines state

    "A conviction for a statutory offense will
    involve moral turpitude if one or more of the elements of that offense have
    been determined to involve moral turpitude. The most common elements
    involving moral turpitude are:"

    but there was'nt a conviction so he'll be kool and the gang

    Answer to that one would be Yes.

    Don't rely on any answers here. Get advice direct from American embassy.

    I'd be interested to know how you think you could do that, as all calls are handled by an outsourced call cente in Glasgow.

    You should also be aware that advice from call cente staff is taken in the same vein as advice from embassy staff, its NOT legally binding.

    CBP work under the DHS, and are responsible for ESTA, NOT the "American embassy".
