  • It's time to be more assertive with them: send a recorded letter saying you can only afford £5 per month. Stick to your guns and no phone calls; ask for payment slips you can pay in to the bank with cash. If they don't like it what are they going to do? If they're daft enough to apply for a ccj, it's easy to convince the court you can only afford a nominal amount...Westminster sols know that and they will back down.

    Despite what happy_bunny's sig says, you do NOT need to send the letter RD. Proof of posting (free from the post office) for a first class letter is enough to have it deemed received two working days later.

    Also if a cheque enclosed is cashed it is pretty firm evidence that the letter arrived.

    Yes I agree, just bored of getting no response to letters :)

    As you say, if they cash the cheque they got the letter.

    Hi both, Thanks for the advice, I will do that, my main concern though is that they won't change my address therefore I wil have no idea if I am taken to court...any ideas on what I can do?

    If I am taken to court...will the fact that I have been sending checks and they have been cashed, show the court I am trying to pay the debt off and therefore they won't take the case any further?

    If they won't change your address, complain in writing. If they need proof to change your address they have to tell you how to go about this.

    If they did take you to court at your old address and you have evidence you told them about the address change then that's grounds to get any CCJ set aside.

    Tell them you will be referring to FOS after 8 weeks should they fail to respond. Will cost them £500 for that....although goodness knows which address they will send it to :)
