It's rare for this to happen unless she owes significant money to HMRC, other companies won't because it just doesn't make sense for them. Some means tested benefits mean you can get a discount on the court fees so this is worth checking out but again unlikely if your OH is working f/t. £640 sounds a lot but if you're not paying anything to mortgage and debts for a few months first to save up for rental then you should have more spare money - don't stop paying rates/student loans as these aren't included in bankruptcy and utility suppliers could refuse to supply you after bankruptcy if you have arrears so get advice on this as supplier choice is limited in NI. Best plan is to speak to StepChange - CAB sometimes are ok if you get a specialist money advisor but a lot of people on the bankruptcy board have been really pleased with the help they got from Stepchange so...."I cannot make my days longer so I strive to make them better." thanks everybody for the replies and pms. as some of you mentioned the option of bankruptcy is definitely the most appealing at the moment but as you know this is something which is possibly detrimental to my OHs job and it is definitely something I can't do as i will lose my job for certain. I am stuck between a rock and a hard place! If I just gave back the keys then yes the house would eventually be repo'd and sold off with us responsible for paying any shortfall. Think lender has up to 12 years to pursue us for that or make us BR. Seeking advice from employers, unions and IP at the moment to see what our realistic options are. We don't want to go BR if we lose our jobs as that will be us on benefits and it was hard enough to get secure-ish jobs as it was without the prospect of long-term unemployment ahead of us. So in the meantime we are at the serious advice stage before we make final decision. We don't want to make any impulse decision now due to stress and emotions which would affect a better future for us. Thanks again.0

Its been quite a while since you first posted on this situation, so don't keep torturing yourself and beating yourself up, struggling this hard to keep your own home can't be the best option.

An update for those who remember me. I can't believe it was April that I last wrote on this site. So much has happened since then. Moved out of the house and into rented housing, mortgage company has repossessed, house is still for sale and I am pretty much as relaxed about it as I can be. Am just playing the waiting game of being made bankrupt as I can't afford to do it myself. Have good days and bad as I still can't accept that I will never own my own home and all the money we paid out towards the mortgage and loans etc and yet have nothing to show for any of it. That bugs me. However, I can sleep well knowing that the wolves are no longer at my door and that I have exhausted all avenues in trying to sort the mess we were in. My marriage ended during the summer, a combination of financial pressure, resentment and the blame game put the final nail in the coffin of a marriage which was at the end of the road anyway. This situation changes you as a person and you realise what you have to do for the best for your own future.
Thanks to everyone who helped me over the last year or two with all of this, I got many great pointers on this site and have made it out the other side. Thanks so much.0 -

Glad to hear you're getting on ok and are at least more relaxed. I don't know that you should worry about no longer being a homeowner and having spent money on your mortgage and loans because you did what was right at the time. Now it's a different time and your circumstances have changed. I think it's more important to be able to sleep than to own a home you still have to repair, maintain and pay the same utility bills for as renting anyway! Although it's not behind you yet it's at least been put to the side to allow you to focus on your new life. And if the bank chase you for the payments and you can't afford to pay then you go on owing money. The bank won't make you bankrupt because then they will never get a penny out of you, more likely they will keep sending you lots of letters threatening solicitors, court action etc which you can file away somewhere, preferably a big box with a lid you can close on it!"I cannot make my days longer so I strive to make them better."
