citizens addvice have said working tax and child tax need investigating as they have done it all wrong and your right they shudnt ave paid him as i get child benefit and i have my sons doctors medical with me he lives with me and i sent his id off his medical card to them im confussed as how he has been awarded with it ,all they have to do is ask my son an he will tell them his dad doesnt want him and now his dad doesnt want to see him ,im going into tax office to find out whats going on as they wont discuss it over phone with me0

it isnt usual, but it isnt totally necessary to be receiving the child benefit0

a medical card alone isnt proof that he lives with you. your ex could phone and ask for a replacement medical card for his address.0

if he does change his medical card then i dont know what were going to do give up work and go on the dole as cant work as nursery wont have my son unless i pay and cant pay them if i cant work as wont have a child minder ???? one way to get money0

the nyrsery obviously see you as the person the child lives with.
what reason did they give you for allowing your ex to change his details?
obviously they must know him... how long have you been seperated?
does the ex drop off/ pick your son up from the nursery?

my son is 10 and his dad picked him up and dropped him off for two mnths hes not my x we never lived together or been married but he helped two mnths with my son while i worked we shared access but now hes been awarded the money he doesnt want to know his son ,he didnt need reasons the child parents are allowed to change a childs details when ever dont have to consult the other partner a solicitor told me that its catch 22 new parental rights0

Find a family solicitor who does legal aid work and make an appointment. List everything he has done and list what you need sorting out on paper and take that to help you keep on track when you see them. Take anything you have re any benefits you receive plus letters declining benefits. If you have bank statements or similar to prove what money you receive, take those also.
Housing Benefit may be able to illustrate he lives with you? CSA Claim??
Write to the ?school/nursery/doctor asking for a written explanation of when and why they removed you as resident parent. This will illustrate your case that it was done without your consent. The school has to supply details - quote 'Data Protection Act'.
You could report the matter as fraud to the police and there may also be an issue of harassment.0 -
my working tax and child tax credit has stopped due to my son farther putting in claim as from january the 9 ive not recieved it ,i have to send evidence that cameron lives with me to which he does and always has lived with me ,it is 7 march and im struggling,my wages go on rent and bills and only have 20 pound aweek left to live on for me and my son.i have sent his medical card off but they want more evidence what more evidence can i send as it has to have his address on to where he lives ???? my son can not go to school from today as we have no mony and nursery wont have him as i cant pay so now i am struggling with work as got no one to look after him can any body please help :mad:
Why can't your son go to school? Is it because of fares to get there and back? If so, ask the school for help - this will help to show that your child lives with you. You could also ring the education department at your local council for advice. They may be able to issue a bus pass free of charge if you live far enough away from the school (2 miles for primary age|). If you live less than two miles away, there is no reason that you cannot walk there, unless either you or your child have a disability, but this has not been mentioned so I assume not.
You also mention nursery, but in post 17, you say that he is ten years old. Why would he go to nursery at that age? Or is it an after school club based at a nursery? If it is, then they could write a letter - you said that your ex had changed your son's address at school, doctor and dentist (post 9), but didn't mention nursery.
Does the father actually have parental responsibility? For unmarried parents, the father does not automatically get parental responsibility for children born before 1 December 2003, even if named on the birth certificate (and if your son is already ten, , he must have been born before then). The only way he could have PR is if you agreed to it or if there is a court order.
Incidentally, although my ex does have PR for our children, I doubt if either of my son's schools would just change the details to his address without contacting me.
