Compensation refused by TUI: 2 year claims limit

Hi, any advice welcome. TUI have refused to pay up on a 22 hour delay as it's more than 2 years (just) since it happened. Any suggestions about if I can write back and quote any legislation / guidance to object?

I'm in the process of making a delayed 24 hr. flight compensation to Thomson. This is under the EU Regulation 261/2004. I received a reply recently quoting that Thomson "apply the international carriage by air subject to the framework of the Montreal Convention and claims have to brought within two years". Therefore my claim is out of time.
I have replied that my claim is under the EU Regulation 261/2004 which any claim can go back to 2005. I have read the Montreal Convention which states the time limit for England and Wales is 6 years! I also found no mention of flight delay compensation in the Montreal Convention!
I am awaiting their reply. I will contact the CAA and the European Consumer Centre next as advised by Martin Lewis if I still have further delaying tactics from Thomson.0
