Santander letters 4 years after Bankruptcy

Almost 4 years after bankruptcy I still receive transaction statements telling me that I have a large balance. The credit file correctly indicates that the amount is satisfied but Santander refuse to stop sending me their reminders.

I've contacted Santander several times in the past to have them stopped but without success.

Today I escalated a complaint and duly received a call back to discuss the issue. I explained the situation and was told that the bank is allowed to send letters up to 6 years after bankruptcy. I then asked why they would do it, and what did they hope to gain? The response spoke volumes, "because we're allowed to, to be honest".

It seems from my perspective that Santander's intention is punitive. Does anyone know if this is actionable through the Ombudsmen?

    Why not ring them back and say " if you send me any more I'm going to make a formal complaint, will not be satisfied with your answer so will refer it to the Financial Ombudsman, which will automatically cost you (Santander) £500 whether you are found to be right or wrong - Why will I do this? - because I can, to be honest!"

    I am still getting similar MORE THAN six years later. I like the debt doctor's PoV though!

    I'm not sure if Santander actually care whether you cost them money, as long as the get to be awkward and annoying?

  • I have been getting these letters also thought it is over 5 years since my bankruptcy. I believe this is due to Santander using these my bankruptcy loses as capital. Thus by Santander saying it is owed so much it is allowed to borrow more. This is a fruad in my view.

  • could you not just write on the envelope "Return to sender" or "Not known at this address" and post it straight back?
  • I have done so in the past but.... as I mentioned in my last post, Santander are using these debts as capital.... thus this allows them to borrow more. remember santander needs to borrow also .... so when Santander turn around to investors etc and ask for money Santander says to them this is the money that is owed to us and we charge a specific interest rate etc.... they do not tell their investors what should be written off.

    I would like to highlight an issue with you that is causing me a large amount of concern. I have attempted to resolve this matter at lower levels but unfortunately your staff have not been able to provide any resolution, so it is with reluctance I seek your help.

    A number of years ago I was in a difficult financial situation which resulted in my bankruptcy. This was an upsetting position, and whilst I am not looking for any empathy from you on this point I would ask you to consider the distress I was in during the bankruptcy. I named Santander as one of my creditors.

    Your staff have already resolved the outstanding balance on my credit reference report and this is now marked as settled. What is still upsetting though I frequently receive transaction statements indicating I owe a large balance. What upsets me further is when I have queried this, your staff have suggested they continue to do this simply because they can.

    I have no idea why you continue to do this but my bankruptcy happened a number of years ago. As you will be aware there is no possibility to obtain funds from me on the outstanding balance in question, in fact it would be illegal for me to pay you under current UK legislation. Your actions though keep serving as an ongoing reminder of part of my life I would rather forget. I consider these actions almost tantamount to harassment and the Department for Business, Innovation and Skills sets down legislation preventing companies to act in this way.

    I would urge you to intervene in what is actually a relatively straightforward matter - please stop sending me these transaction statements and ensure my accounts with you are marked as 'settled', sending me confirmation for my records.

    Once again my apologies for escalating this to your office but it is not without me attempting numerous times to resolve this with staff at lower levels within Santander. I appreciate your efforts to support my request and hopefully save both of us the requirement to involve outside organisations to rectify the problem.

  • If it was me I wouldn't even bother opening them. Surely receiving an envelope you don't even have to open, is a small price to pay against the peace of mind of having your debt sorted ,albeit through bankruptcy ?
