Another Wing Parking "charge notice" ?

Hi guys,

I have been following this forum every once in a while when needing advice but only now considered to register as I got a fine last week :)

I just want to check if I can ignore this fine as it just seems ridiculous on the way it was given.

My "fine" says: Parking Charge Notice, no legal act cited or council logo.

I had my valid yearly parking permit issues by the council displayed but only 80% of it meaning you could see the registration number but not the hand writing in the bottom which specifies the dates range.

However, I have appealed on their website and they immediately rejected saying : although the permit is valid, at the time of the "fine" it wasn't displayed correctly! :) LOL ?

I am moving from here and also selling my car soon anyway, and I just wanted to know if I choose to ignore this and not pay it (it's rubbish if you ask me!! I have a valid permit and always had one!) can something legally happen to me ? Or do they have some rights to list me somewhere with this in order to create some problems in the future like you know, bad credit score because a bill wasn't paid, etc (for only £60 I would prefer to pay it in such case)

    A council issued a permit to park on private land ? It's coming to something that is ! Anyway wing are well known on here and try to make their tickets like council issued tickets by having a council logo on them. Despite complaints it continues.

    The advice is to ignore them as its highly unlikely that it will go to court, they just send junk mail out. If you are moving ensure that you have mail redirect from the Royal Mail (you should do this in any case) , and just ignore everything short of a mcol letter which as mentioned is not likely.

    Live life and just laugh at their pathetic attempts to get money off you.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Sorry, maybe I haven't explained properly: The council in Lewisham,London (they are called L&Q) are issuing one "Wing Parking" yearly permit for the residents and this is what I had in my window - so the computer written registration number which was visible was actually issued by Wing!

    In the response to the appeal they actually LIE and say :
    Our operator was unable to see the registration number or start/expiry date of your parking permit. - > not true as the registration is computer printed and is visible (their photos are CRAP and you cannot see that in the picture though lol :))

    It's not the Council it's a Housing Association which is an 'at arms-length' separate entity from the Council:

    I would appeal it and then appeal again via POPLA as it costs Wing money and is not even binding on you (only them). Word the appeal correctly for POPLA and you will win it, so you need your points about the permit and additional stuff about Wing not owning sufficient or any proprietary interest in the land, as discussed in this thread:

    WP would have to go some to have proprietary rights as this is almost certainly council owned land. And let me guess? - the notice fixed to your car was emblazoned with the council logo.

    In their last response did WP detail how any further appeal process works and who it should be directed to? WP work acoss London for a number of councils and appear to have quite complicated appeals processes including some that have three and four levels. It would be good to take one through that number of levels and ultimately to POPLA.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    there is no council logo ...just the WP logo.
    I will read again in detail and will try to appeal again after I read some of the threads here on how to word it - i still don't know about this POPLA :)

    can I just respond online to their response to my appeal (there is an online way to do so) or should I start a new appeal ?

    LE: guys - i am reading and reading and reading ...but, i am still not sure how to act.

    currently i went through this steps:

    1. i got the PCN on the 27th feb
    2. i appealed same day saying i had a valid permit
    3. they responded with a report that is online and i can choose to reply to there; they are saying that although my permit was displayed and it might be valid at the time they checked it wasn't clear
    4. THIS is where i am now, trying to respond to what they have said and maybe go into phase two of the appeal

    what do you recommend me doing at this stage? should i try to write a strong worded letter letting them know i will not pay? or should i pursue POPLA ? if with POPLA, where exactly do i need to go to submit that, it is not really clear at this stage, nor the way i should word the appeal.

    sorry if these are all newbie questions, but my first language is also not english so i just want to make sure i am doing the right thing.

    note: too bad i am a new user and i can't post links, i could have just provided the link to the response to my appeal. i can copy/paste it here later maybe ...; anyway, there is nothing in it about how i could appeal to POPLA like i saw other people got with their appeals so this company is rubbish!!

    Tell them that you have made your appeal, you have a valid permit, and that they either accept your appeal, or deny your appeal and issue a POPLA code.
    You then take your appeal to POPLA. Dont mess arround playing letter tennis with the PPC. You have made your point, they either accept it or not.

    Or wait 35 days from your initial appeal for them to give you a POPLA code. After that time write to them saying they are out of time according to the BPA and that your appeal is therefore accepted.
