AP markers vs Defaults

  • I had a similar case with barclaycard. They do not care even after I complained to the FSA. I have managed to finally get the file deleted after it reappeared only because I paid up.

Update on this. To my amazement a letter arrived the other day from Barc. An apology. They accept that their lack of default on my file would have a negative impact and agreed that they should have added a default as of September 2010..

The key is that they formally closed the account in September 2010 and passed it to collections. They say they should have defaulted my file then and will now mark my file as defaulted in September 2010 which is fantastic news for me as it means all accounts are now due to fall off the file in late 2016. At last I have a date to look forward to and can get on with clearing the debts.

Hats off to Barclaycard in this case. Despite taking 2 months to respond to my letter, they have sorted it to my satisfaction. There was even a little compensation in there as well which caused me to have to sit down for quite a while staring at it!

Better still if the account is in default it gives Cabot one less stick to beat me with. In fact it puts them seriously on the back foot as this is a very old CC account which they must know they can't enforce if push comes to shove.

I'm not sure how I've managed this but if it helps anyone, the letter I wrote was firm but polite and was a request, not a demand. I thought it was better to go in softly initially and not all guns blazing. Seems to have worked.

I await my next credit report with baited breath but at least I have it in writing now!

This is fantastic news, well done. I'm 3 yes into a dmp with AP all over my file. Never missed a payment or reduced to token payments I'm with BC too. Would it be cheeky if a you could throw up a sample letter.

    Many thanks

Great news! Between us DH & I have 5 Barclaycard accounts marked with AP. We are nearly 2 years into a very long DMP, and I know they could wait until near the end to default us.

There should be a law about AP's, it's unfair when you are doing your best to pay them back when there are people who pay nothing; get defaulted straight away and hey presto! 6 years later they have a credit file free of bad stuff.

Please PM me for copy of letter I sent if you want it. Would rather not post in public forum.

Just to add to this, Barclaycard rang me within a day to sort out the AP's, they have now been removed and sorted. I am still currently waiting for Capital One to at least acknowledge my complaint. It will be 4 weeks on Sunday, so a call to the FOS on Monday should I hear nothing.

Barclaycard today have refused to remove the arrangements to pay and add a default as requested. I guess my next step now is to go to FOS and see what they suggest.

Not impressed with Barclaycard at the moment!

I sent my original letter to capital one 8 weeks ago today, with a follow up letter 4 weeks ago. No responce from them! Not even a letter of acknowledgement! Letters were sent recorded. FOS will be called today to move things along.

Rang the FOS yesterday, who posted out some forms to start complaint procedure. As luck would have it, I recieved a responce from C1 today. They acknowledge that had i not made an arrangement to pay i would have defaulted sooner. They are going to remove all information from my credit reports! :T For those of you that had have the same issue, it only takes a letter and a bit of patience.
  • Make sure they do it though. I have the same issue with CL Finance, they said they are going to do it but they haven't so FOS it is for me as well as the ICO!

Excellent news. Shows that they are taking the p with the APs, and hope you aren't clued up enough to realise.
