You are seriously confused.
I'm making no comment about the rightness or wrongness of the criminal law.
Both common sense and civil law say that if someone contracts to supply you with something that has been checked then they should provide exactly that.
What I said was stupid was the argument that because criminal law holds one person responsible for something that in some way absolves anyone whose failure is relevant in the chain of events that lead to the offence from blame.

Dont see anything wrong with that, I cant see in this situation where they said sorry and that was it either they offered a remedy and you didnt take them up on it.
Why should they reimburse you for buying the liquid? What is to say that you just bought one and are just giving them a receipt for a bottle? They need to check to see if this is the case they isnt any in there.
I also think you are a fool not to take out 15 minutes of your time to bring it back because I bet if you did they would check everything else on the car, because if they missed the washer fluid what else did they miss in their checks? I know I would be getting it checked or asking for another car. Also there would be some sort of protocol that whoever signed it off as checked hasnt checked it and will need to be dealt with internally as they are a risk to the company
Oh and one last thing, when you got in the vehicle did you check to see how much fuel was in there?
15 mins - more than that. OK so I waste an hour of my time during which I'm not billing my customer. and its their mistake. Would cost me more than the cost of the daily rental in lost billing time.
Or I'd be here an hour later tonight thus spending an hour less with my family because some donut couldnt be arsed to check the levels. Different opinion now?0 -
I'm not a driver, so forgive me if I'm wrong. But isn't it the drivers's responsibility to check the presence of washer fluid, (and indeed all other safety items,) before each journey. Saying that someone else is supposed to have done it I suspect would be insufficient if checked by the police,

It is not my proposal, it is what I would do, very different.
If the garage were smart then they would not pay a fiver for the fluid but would send someone out with a replacement motor and collect the "faulty" one. By paying the fiver as you have it they then IMHO leave themselves wide open due to the for any prospective claim if there is a failure on the car say in a accident or damage, regardless what their T&C's say.

Thinking about this a little more, why did the OP not just put some water in the bottle?
You only need the very mild detergent in screen wash for summer time when there may have been no rain for some weeks and a micro-fine layer of oily dust may have built up on the windscreen.
With the amount of rain we've had this year plain water would be perfectly adequate. (And water with a drop of washing up liquid was what many people used for years before some bright spark came up with the idea of pre-mixing it and charging extra.)
