Aintree NHS / Trethowans lose in court again

The full story on PePiPoo: http://forums.pepipoo.com/index.php?showtopic=76701&st=0

In summary, a NHS worker was asked to carry out duties at Aintree Hospital, was told where to park, and was then issued with a ticket which they refused to cancel.

Case went to court, thrown out by the Judge, costs awarded to Defendant.

The so-called management at Aintree NHS just never seem to learn, and seem happy to continue wasting taxpayers' money pursuing their unlawful "parking charges".

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Hospitals waste money on this whilst making people redundant....

The legal eagles are laughing all the way to the bank, while the NHS trust wastes even more money.

foi request to the hospital asking how much they have spent/lost in court costs over parking?

I seem to recall that this was done not very long ago and revealed an horrendous amount of money going to Trethowens. Not that they are bothered.

There is clearly no merit to the hospital's case (as if that was a surprise) but they persist with these cases in such a way as one is almost obliged to conclude that they daren't ease up for fear of blowing the gaff on their money-making scheme - even if that is not actually the case. Managing car parking is a poisoned chalice - as anyone who has done it will know but trying to impose what are clearly intended as penalties on top is taking things far too far.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Somebody over on PePiPoo is suggesting that this would make a very good story in the local press.

It's a shocking waste of money, chasing their own employees is despicable, and going after the patients is simply a jaw dropping thing to do. I would take this to bbc watchdog and see if they want to run another ppc piece, they normally do 1 or 2 a year ;)

I did a FOI request in two years they paid Trethowens over £116,000 and recovered £5000!

    You asked:

Amount of money paid by Aintree NHS trust to Trethowans solicitors to
pursue unpaid car parking charges over the last two years!

    2010-11- £53,093.65

    2011-12- £63,479.83 to date

If you require any further information please do not hesitate to contact
    us.

Brought this to the attention of the local paper and radio they were not interested.

I would have thought the various NHS unions would be interested in this story. Not only was a NHS employee hounded just for doing their job, but that "wasted" money mentioned above could have been spent on patient care or for employing some more staff.

The question to ask is how much paid to this company, and how much money was recovered in parking charges through them. And many cases went to court and how much money was paid through the courts. And finally how many judgements were made against motorists
