Car insurance and licence in the same name?

My employer has stated that as my drivers licence is in my maiden name, and I'm on the company payroll in my married name, that I'm not allowed to drive any company vehicles as apparently this is illegal?

Is this right?

The way I see it, both Mrs X and Miss Y are my names, both are legal names, so does it make a difference what name is on my drivers licence?
Can't think of anything smart to put here...

    You are stopped by a copper. He checks your licence, then checks the insurance. You are not insured to drive the vehicle in the name on your licence.

    He decides to consider prosecution for no insurance.

    The question is, would the CPS proceed with a prosecution?

    Is there any reason why you have not had your licence changed into your married name, if you have informed your employer that that is how you wish to be known?

    The company policy is more likely to be any driver, the problem is probably caused by the companies H&S duty to ensure the company drivers have a valid driving licence. The different names possibly messes up their system or they suspect there may be a problem.

    I haven't changed my licence over to my married name simply because they charge me for a new licence. I'm waiting til it needs to be renewed.

    It's still my name though! I understand that it may cause my company some hassle, but is it actually illegal? Is my insurance void as I don't have my new name on it?

    The employer have a duty to ensure their employees who drive company vehicles or their own cars for company business have a valid licence. Having a different name on the licence to their payroll probably upsets their paperwork.

    Try asking the DVLA whether it's illegal

    I have a feeling you are only allowed one real name, which you must use consistently, and not use any other name in a way that might cause fraud, or suggest to anyone that it could cause someone to suspect fraud. It's use must be transparent in fact.

    It can be any name you like - maiden, married, invented, changed, but whatever it is you must use it consistently.

    I have recently had complications satisfying a financial institution's money laundering requirements because some utility companies use a single forename, others have registered me under my 3 forenames' initials. This threw up a discrepancy in their eyes which took a lot of correspondence to rectify.

    Another company queried a tiny spelling difference in a name in my address.
    I'm not surprised you have problems using a different surname.

    Your employer doesn't have to let you drive their vehicles.

    Why not just comply, or give up driving a company vehicle?

    If you have a licence, you are licensed to drive a car regardless of what you call yourself. Full stop.

    And it's up to you whether you change your name on marriage, keep your maiden name, or change it for some purposes but not others - for example a professional with a good local reputation may decide to keep working under the same name even if they change all the other official documentation.

    And any insurance which applies to a person or class of person (eg: all employees) will still apply regardless of what the person calls themselves and what name is on their licence.

    So it's not illegal. If anyone says it is - please ask them the Act and section number of the law they claim you would be breaking.

    It's pretty easy to prove to your employer that Mrs Bloggs is the same person as Miss Jones - just show them your marriage certificate.

    However, having different names on official records may cause short term problems. Having a driving licence in one name but a car registered or the insurance in another name could end up with your car being seized if you can't convince the officer at the roadside that they are both the same person.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
