Ebay seller threatening to take me to small claims court. help!

  • If this was a business seller do the distance selling regs apply to cars anyone? Not relevant if it was a private sale obviously.
  • As an aside to the OP's post;
    I have twice made offers under the Ebay system in the last year, both offers were not responded to by the sellers within 48 hours as the system requires and have then received private acceptances, asking when could I pay and collect.
    It seems to be a common way for sellers to avoid Ebay fees
  • Tell the buyer you will happliy agree to cancel the transaction which will get him his fvf back.
    Otherwise just take the strike.

    I have never received an offer once any official offers I have made have expired, nor have I ever done it as a seller, I don't think itniis common at all . However, in your instance, unlike the OP in this case, a private acceptance does not make it in anyway binding on the buyer. Only if seller properly accepts the offer through eBay does it become a completed sale.

    I have a sympathy here with the seller as well. Surely a buyer who makes a formal office should check their purchase history and not just assume they haven't won something. This is not a 99p trinket, this is an £800 car- a 30 second check om status of offer is surely not too much to expect?

    Sellers often ask on here why do people just not pay as it seems odd especially on a BIN with best offer, I don't think it would have occured to any of us that buyers don't actually bother to look at their ebay at all.
