    The OP had to swerve to avoid the other vehicle, which had changed direction suddenly - the actual presence of the vehicle on the road is key to the collision between the OP's vehicle and the wall. If the other vehicle had continued turning left, the OP would not have swerved to avoid it. Exactly how much blame can be apportioned to each driver has not been determined.

    This is the thing though, the OP didn't have to swerve to avoid the other vehicle (well they did) they could have waited until it was safe and clear to proceed,m some drivers would bear right to execute a left hand turn. Nobody is saying the OP is a poor driver, but experience now suggests they will not allow themself to be in that scenario again, likewise if somebody bumped into the rear of a vehicle at the entrance to a roundabout because they thought the vehicle in front had gone.
  • The op was engaged in a legitimate overtake manoeuvre when the vehicle being overtaken made an unpredictable change of course at the point the op was committed to his overtake. I fail to see what the beef is here.

    Put it this way, if the op was my client, on the information stated by him in this thread, I wouldn't hesitate in hosing down the other party and I feel the risk of contrib against him is minimal.

    How many of the prolific posters in this thread actually deal with RTA claims for a living?

    Take his case on then, me? I would gladly represent the party of the vehicle in manouvering car... if only they had a case to answer :eek:

    Isn't it the case that the driver behind is always to blame.

    Been involved in a similar incident I was the vehicle in front taking a tight left turn I was in a van and signalled left to turn and as its tight I pull out right to swing in. Car behind me kept coming and I collied with there drivers door.

    The driver behind was found at fault. But the main difference in my case no police involvement.

    I know with our legal people they'd argue the case and get blame on rear driver.
