0 points to 15 at tribunal this afternoon. Nice and quick, just a 10 min chat and I walked out with a decision letter in my hand. If only the real medicals were like this...
Thank you to all the people posting in this forum, your expertise and warm words d encouragement helped me get through the stress of this last year mostly intact, thank you so much, and to everyone still fighting this broken system - don't give up, there is light at the end of the tunnel, keep going.
I won my appeal, the stress of the whole thing was terrible. Less that 3 weeks after getting the letter to say I had won my appeal I got all the forms from atos again, I'm going in for an op soon, yet here I am, back at the start of the whole atos nightmare again. The way I'm feeling at the moment, well I feel like just giving up.0 -
it's awful.
i have had a smooth ride with ESA medicals, but i have a condition that can be measured accurately, so there can be no dispute. in that respect i am lucky.
but with all the changes in housing benefit and council tax benefit...
and looking forward to PIP and universal credit..
i'm getting severly stressed about it, so i cant even imagine how those who have to fight through the ESA process feel0 -

The fact is that the OP (and many other people) need to direct their frustrations at the DWP, they are the ones that decided the awards. They are also the ones that need to change their processes, to give more weight to the evidence supplied by the claimant.
Which very few claimants do, simply because of what we see on this and other forums that both ATOS and the DWP don't actually look for any other evidence other than the ATOS report. Claimants are generally of the opinion that neither ATOS or the DWP are interested in anything that the claimant sends in.
The claimant may, if they so wish, send some evidence in, but they are not expected or required to do so.
At a Tribunal it is a completely different story as the claimant has a duty to supply the evidence if they expect the tribunal to rule in their favour.0 -
and,this system is supposed to save money,but a lot of people have to the tribunal route,therefore costing this money saving government,more money,,strange but true,false econmy me thinks,,and starting in April,we have the PIP assementsa starting,and probably even more tribunals0
