Custom Sports/Acting Equipment broken - Not your average good!

Good Afternoon all!

Quick question about custom made goods… a little outside the ordinary that I would be keen for some help with.

Very briefly the situation:

As part of various hobbies including acting and western marshal arts I take part in, I ordered 2 sprung steel custom made swords from a blacksmith in 2011.

I received them and briefly used one of them in 2011, before noticing that the blades started to bend an indication that the steel used is not N45/sprung steel.

I reported this fact to the blacksmith who was willing to accept fault and re-temper/re-forge the blades, and they where dutifully returned me 3 weeks ago with all appearing well.

However I recently discovered that both blades (one I had not had not returned to be re-tempered as it appeared to be fine) are still bending. Given that these are and where ordered on the basis of being actively used in live steel combat, they are completely unsafe to use in case of shattering. I have spoken with various blade smiths on the blades who have suggested that the blades are not N45/sprung steel and are unlikely to be able to re-tempered/re-forged and would have to be completely remade from the right steel (I am pretty much a layman on their construction).

So… can I claim a refund? Or ask for them to be completely remade?

It appears to me that are inherently flawed from the outset, but I am keen to hear peoples thoughts as to what can/I should do on the subject.

    After six months the onus is on the customer to prove an inherent fault, you will need to get a written report from one of these other blacksmiths to the effect that the material is not as described and not fit for purpose.

    Have you approached the blacksmith yet and asked if the correct steel was used & asked why this is happening/how it can be prevented?
  • I did previously contact him (and send the blades back) to be re-tempered and he did admit that there may have been a problem with the steel.

    I have emailed and written to him (just in case I need a record) outlining the problem and I am currently awaiting a response.
