Retailer wont give back my deposit

Hi,
Could any one please help me for the following situation:
i put down a deposit for a gas fire at £549 i left a deposit of £49, an hour later i checked on the internet only to find it for £440, the independent retailer told me that this product was unavailable on the internet.
I contacted the retailer and asked to cancel my order as he could not match the price, to which he replied that he will not give me deposit back as it is printed on the bottom of he receipt.
I did not receive the receipt or was told that any deposit was non-refundable until after i had paid the deposit with my credit card.
I contacted the retailer in hope that i can get my deposit back but he put the phone down and refused to talk to me.
I was UNAWARE that the deposit was non-refundable until he told me after i wanted to cancel!
And he wont give back my money! which seems really odd as it has not cost them anything as i cancelled it before they even put the order into the supplier.
Could anyone please provide me with any advice as i feel that i have been robbed!! Customer service was great when i wanted to buy something but appalling when i wanted to cancel.
Any help or advice would be greatly appreciated.

What was the reason for leaving a deposit ?

there was no reason to leave deposit, other than to leave a rounded balance to pay0

So you have agreed to buy the item and entered in to a contract with the retailer and now expect to break the contract with no penalty or cost?0

yes why should i not get my full refund? they did not tell me that it was not refundable neither did it incur a cost to them as i cancelled before they even put the order into the supplier0

but yes I would say you are entitled to your deposit back...getting it back however is the tough part.
Ultimately I would suspect you need to send them a letter before action and then maybe goto small claims courtDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

Quite often deposits are none returnable (when you pay a deposit for goods a contract is created between you as a consumer, and the supplier of the product or service. You should be clear at the time of paying a deposit what your obligations are).
You should have either sought the price in store and asked to buy without leaving a deposit (any good store will get you the goods without the need for a deposit), take away the price and item details and then searched on line for price comparisons or searched on line first and tried to source locally.
The whole reason on line prices are as low as they are compared to the high street is because they have no overheads and often very little staff so do not hike the prices up for the customer.
Whether they subsequently placed and order with a supplier or had not got around to it, the onus was on you to check if the deposit was returnable or not.Everything has its beauty but not everyone sees it.0
