GAP charged me £34 for nothing!

Hi there,
This morning I found that my current account was overdrawn, to my great surprise. Yesterday gap.eu charged me £33.97.
I haven't bought anything from GAP since November, when I paid on a different card (and a different amount).
I spoke to a GAP customer services person this morning who said that they have had several similar calls and expect that there has been a 'payment glitch'. I am to call them back later today when their main services people are in the office (they are US based).
I expect to be refunded. I hope that GAP will pay my overdraft fees as well.
However my main concern is that they still had my card details, possibly as much as 6 months after I last used them with the company. Is this permitted?
This is a really weird situation, and it would be great to know what people think my rights are.

It may be worth speaking to gap again and asking them to send an email confirming that the payment was taken in error.
Then contact your bank and explain the situation, if you have the email to show it will help. They may just reverse the transaction and clear any charges.0 -
Report it as fraudulent unauthorised transaction with the banks fraud team.
Getting past the goon who answers the phone can be a challenge, sometimes you have to put the phone down, call again a hope to get a goon with a few more brain cells.Be happy...;)0 -

Ring your bank.... Ask for disputes team.
As its a unrecognised transaction. It has to be refunded straight away under PSD (payment services directive) as the same as they have to remove any charges due to this.

Its not fraud. The OP has contacted the Co and the yhave admitted a processing error.
reporting as fraud will see the OP without a card... All for nothing that can't be resolved in a few days, when the retailer refunds.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -

But it isn't clear which card the OP is referring to in the second quote. In my opinion it is quite right to confirm how GAP has the card details.
It may well turn out that your interpretation is correct. However we have all seen what happens on here when people make assumptions!0 -
Well it would be a very long stretch if the OP had used a different card at Gap and they had then somehow managed to charge the one he is now concerned about. Occam's Razor and all that.0

It's not fraud as other people have pointed out, and GAP have admitted that they have made a mistake. The USA are on a different time zone, it makes sense that they can't deal with it until offices open, doesn't sound like they are trying to make up excuses.0

Nope. Sorry. Can't think of any "tax purposes" why any business would have to keep the card details relating to a particular sale. Why do you think HMRC would be interested in the card details, and what do you think they'd do if they had them?
