to be fair, if the OP only claims tax credits and no other benefit, then it would be am obvious assumption that it must be about the tax credits?

another thought! you switched back in sept 2012, so your husband was unemployed? did he then claim JSA for a time? perhaps they think he was working at the college and claiming JSA.

This is so pain full, it's like trying to pull out teeth, the OP just won't give a straight answer yet expects help and advice.

There is definitely something not right here, either they have a very dogdy employer or they are in fact self employed, you don't get a P60 in December unless the employer is incompetent.

There are so many inconsistencies that it's pointless trying to help unless the OP is more upfront with the true facts. Not just their interpretation of the facts.

No wonder the DWP are suspicious that something dodgy is going on !!

also, this investegation may not be about current benefits,
it may be historic and could cover the period when the OP's husband was claiming benefits (other than tax credits)

OP... this could be about any benefit you and your husband have ever claimed, at any time.

as long as you know that you were entitled to claim what you claimed and when you claimed it, there shouldnt be an issue.

as has been said, it cant be about tax credits, as it would be HMRC dealing with it and not DWP
  • Firsrly thank you. I assumed it was regarding tax credits as this is the only benefit we have claimed. We claimed JSA a long time ago. My husband has some mental health issues so I have always worked. He has looked after our children.
I really am giving you straight answers, I really don't know anymore than I am already telling you.
Secondly, I know a P60 is normally given April/may Mine is sent to my employer who then gives it to me, yes it did take them that long to hand it over, they refused to post it and gave it to me in person with a years worth of payslips

I am sorry if it seems I am not being upfront but I am trying to answer all questions as best I can.

I think we are all trying to get our heads around the fact that you were earnign a relatively small wage and yet were claiming no other benefits.

No Housing Benefit? No council tax benefit? No Child Benefit? No child tax credit?

One other thing I thought of. You say that your OH did not receive any other benefits. Did he, in fact, apply for any other benefits - Employent Support Allowance? Job Seekers Allowance? Was he turned down because of your income but was receiving NI credits?

    Just a thought!

Sorry to bombard you with so many questions - just trying to help. It isn't easy to get the right 'tone' on a forum so forgive us if we come across as a bit abrupt :)

but how did you reach the decision that it was to do with an error from your employer continuing to pay you rather than paying your husband since you said you didn't get any pay slips? That's what I don't understand. Why aren't you replying to my query whether you handed your notice in 2011, or last year when you decided not to return to your job?

A P60 is not sent to your employer, it is produced by your employer, so any delay is again down to a seemingly 'dodgy' employer.

Obviously you would not want to alienate your employer but they do not seem very ' business like ' and it makes me wonder if they are legit.

I work for a payroll bureau - we send P60s to the employer who distribute them amongst the employees. I am quite sure some of our clients don't do this at the appropriate time despite being told to so that could well be the case here. So a p60 vcan 'be sent to your employer' first.

Don't forget it looks like you both worked.

Your NI account has been credited with wages and your OH claimed Tax Credits so joined up that means both worked. IF you claimed any other benefits then they'd be affected by both of you working.
