  • 'insinuationing' what does this mean? ;)

Hello, I got a letter from the tax credit office today insinuationing that I have claiming single tax credits when my 'partner' is living with me. My sons dad moved out of our flat sept 2009, we uphold a decent relationship for our child's sake so he comes to stay every so often, once a month sometimes not even that!
I am at college and have not got time to work between looking after my child and studying so you can understand why I claim benefits.
The problem is, my ex's mail still comes to this address, in spite of me
Sending it back to the senders and asking him to change his contact address I still get his letters!
The tax office have said they have reason to believe he lives here, I have no idea where he lives, all I know is I struggle every month to make rent even with housing benefit help, I have so many debts that I was left with and I am now being asked to send evidence in that he does live here or they will stop my payments.

I am so worried as I only want the best for my boy that is why I am studying to get a better job and lifestyle for him. Please can someone give me some advice on this as I am going out of my mind with worry

    Thanks in advance

Not read the other posts so sorry if i repeat, but you look like you have something to hide. Why on earth would you still get his letters?

You don't know where your son's dad lives? So you never ever take your son to his dads?
  • My Ex is still on the tenancy agreement, simply for the fact that the Letting Agent wanted to charge me to take him off and also do another credit check etc, which I wouldn't have passed. I wrote a letter to the council explaining this and they were happy.

Some relationships are not straight forward but if you are honest about your circumstances then you should be ok.

    Insinuating- I misspelt it...

And no I don't know where he lives so taking him there would be hard! I get his letters because he is too lazy to call up people and tell them he's not here and also I think a lot of them are chasing him for money!

The key thing is share finances. You need to show that you pay ALL bills yourself. So start picking up your bank statements and showing that all that comes in comes out. In a way, the fact that he doesn't pay maintenance makes this exercise easier. Show that you pay the full amount of rent on your own, same as nursery, show food bills weekly and that you would struggle to feed two grown adults and a child on that amount. Show that the costs of days out/holidays were for one child and one adult, not two adults and a child. Show that you have no regular amount coming in from him that could be perceived as help towards bills/rent.

Get statements from school, neighbours, college tutors, anyone you've spoken to professionally who can confirm you have referred to yourself as a single mum.

Thank you, I will do all of these things, won't be hard as all the bills go out of my bank, except gas and electric as I am on pay as you go but I have receipts and letters confirming I am.
I can do the food shopping, but we don't go on days out that cost anything as I cannot afford them simply!
I haven't had anything off him since he left so that won't be hard

Thanks for that advice it helps a lot!

hi OP - sounds to me like a complicated situation but you arent doing anything wrong in claiming what you are entitled to.

things you need to think of (as well as all previous good advice) would your neighbours describe you as a couple or single?
a statement from them may be helpful.

a compliance officer will most likely want to visit you at home - they will then see no evidence of him living there: no clothes, toothbrush etc.

how old is your son? if he is old enough to talk about his home life maybe the school could confirm Daddy doesnt live at home?

things like name on tenancy, letters etc can be explained, just as you have done so to us.

good luck and i hope all goes ok.

That's the problem, HMRC very rarely visit at home. They go off the paper evidence and it is hard to 'explain' why things are joint. If you search this forum you will find lots of people who have had their tax credits stopped in similar situations.
