Tpft Insurance and no fault claim

I am hoping someone can help me?
Yesterday a driver crashed into my car when he tried to get in front of me in a filter lane. I was in the left hand lane and he was in the filter lane with arrows on the road directing to filter in. There were no cars behind me and a car in front of me, so there was no need for the driver to try and force his way in, he was also very very abusive to me.

To cut a long story slightly shorter, I am insured TPFT (first time, I usually insure fully comp :( ) I got home and phoned my insurance broker who wasn't interested in the accisdent, but more in any injury and arranging a courtesy car. I was then advised to phone my insurance company direct, who after taking all the details informed me they wouldn't do anything and that I would have to arrange things through the third parties insurer.
Now I am new to third party fire and theft insurance, but it doesn't seem right that my insurance company expect me to fight the third party insurers without any assistance! I was not informed who to contact, what to do, what will happen to my nine years no claims bonus....but don't worry, I have a solicitor acting on my behalf in case I am injured?????
Does anyone know what I am expected to do myself and where to start please?
Thank you in advance for any help.

You chose not to insure against damage to your own car so your insurers, quite rightly, are not involved. They will however respond to a claim from the other party if one was to arise.

    Did you take legal cover?
  • No :(
I have been insured fully comrehensive for the last 10 years and only chaged to fire and theft because I am now an NHS student and thought the saving would come in handy, how wrong was I.
Hard lessoned learnt, and one mistake that will not be replicated.

If you didnt take legal cover, and are only tpft your policy doesn't cover you in this instance so there is no reason why your insurance co would be interested in helping you. Your not paying them to unfortunately.

Contact the other parties insurance co directly.
  • OP, do you know who the third party insurer is?
  • Other parties insurer is AXA

Your insurer will only come into play if the other driver blames you and tries to claim from your policy.

He tried to get in front. Did you deliberately block them?

No, he was behind me when I came through the lights. As the filter lane started to come to an end he came down the side of my car, causing me to brake as he drove straight into my offside wing.
The driver has tried to blame me, stating that as it was a filter lane, that the highway code states I had to give way to him. He has a different highway code to myself obviously, he also stated that as the only visible damage to his van was half way down the side of the van, he had to have been in front. However, if that was the case, it would have only been my wing mirror he hit, due to the height of the marks on his van. The damage to my car is a big dent in my front wing and a huge scrape down the side of the drivers door, much lower than the marks on his van.
  • So your car's driveable, and you weren't injured?

    Have you called Axa?
  • Car is driveable, although I am not sure how good the wheel is, as looks slightly buckled. The was a funny noise from the wheel for the first half mile then seemed to be ok.
My pride and ego have been injured and I ache like mad, so not really injured either.
Tried to phone AXA today, but they are shut at the weekends for claims.
  • No reason for the bruised ego, he pulled into you.

If you're worried about the wheel, best to avoid driving the car tomorrow and call them 1st thing Monday if you can.

Hopefully they'll ring their insured and get the truth from them, see that they're liable, and start helping you quickly.
