Wrong size shed delivered

I ordered a shed size 12x8 and was sent a 6x8
Main problem is they put the label with the size up the fence and then it snowed. So the first time I've had the weather to look at the shed is now - over a month later to realise it was the wrong size.

I've rung them and they insist I ordered a 6x8 (hence I received that size) but I told them I had an email in front of me stating otherwise. They asked me to forward it on (which I have) but wondering what my rights are please?

I also bought it on a credit card and it cost over £100.

    I would have thought there would be quite a price difference between a 6 x 8 and a 12 x 8, what size did you actually pay for?

  • Well it was a bit of a bargain and they have changed the price on it - but they haven't told me there was a mistake just delivered a cheaper shed.

    I suspect you will be entitled to a refund, not the correct shed sending out. The contract would be formed when they sent the goods ordered; they haven't sent them thus no contract. However they will be responsible for retrieving the shed and giving a full refund.

  • Well they have said that they *think* I can have a refund but need to check they are able to recollect it because it isn't in the packaging.
  • The packaging issue is a red herring. You are still entitled to a refund for goods not as described even without the packaging.
    Thinking critically since 1996....

    It could be argued you've acted in a way that would be deemed to have accepted the item, since it took a month to get in touch

    They clearly haven't sent the correct item. This isn't a minor difference the OP may choose to accept as per the SoGA. They ordered item A, they were sent item B.

    If you went to a garage and bought a car, then the next day the garage sent you a haddock, could you be deemed to have accepted the car if you didn't get in touch immediately to return the haddock?

    No, but if I'd ordered a 4x4 and was delivered a Mini I'd hope to notice the difference pretty quickly.

    How do you not see that a shed is half the size you thought it was? Does the OP have no concept of how long 6' is?
