Made Redundant 1 Week Ago - Was it Unfair?

Made redundant after 2 years 8 months service. Management came in at 9 am and at 9.05 am I and two others were told we were being made redundant (due to lack of work) and to pack our bags and go.

One of us had no employment rights (less then one years service). But both me and the other person had over two years. We were the most experienced people in the admin office. (People in admin were still kept on!) Our sickness records were second to none. No past complaints over our work.

No consultation regarding the redundancies. No explanation as to why we were picked out for redundancy. (The firm is still going, In fact I have been told someone is doing our job).

Advice please!

    Ring Acas or Look at the .gov website.

    How many people worked for the company, I think under a certain amount then no consultation period is necessary.


    You should be paid your contractual notice pay or a statutory 2 weeks. 2 weeks redundancy pay (1.5 per year if you are over 41) and any accrued holiday pay.

    Over-simplification there. Some employment rights are from day One of employment. Depending on the reason why they were selected for dismissal they could still have a claim for unfair dismissal.

    Firm employs less then 30 people so I assume there is no consultation period.

    Paid two weeks lieu of notice and 3 weeks redundancy (1.5 weeks x 2). I just think that no due process has been carried out. The job has not been made redundant (someone is doing it). No selection process seems to have been carried out. No points system or matrix used when selecting people. No prior warnings regarding redundancy

  • Have you appealed the redundancy? This is within your rights to do. I don't care what anyone says, they can't just make you redundant for no good reason and without following good practices. What was your role and are there others who were not made redundant who do the same job. if so this is unfair redundancy.... If you have a number of people doing the same job and some are to be made redundant, then all have to be put at notice and a selection criteria drawn up and all people "interviewed" with the decision based on that criteria and "interview" along with other criteria be it sickness, performance et al... this has happened my wife twice now in BIg companies and she won her case in both occasions..... didn't get her job back but the lets say they "financially felt the pain" for their error and arrogance. ever went to court, both settled when the error of their ways was pointed out by a good employment solicitor... PS check your house insurance for Family Legal cover.. they should cover costs if you have it
