Please advise regarding a fence

HI, I've just bought a house, a new build. The developer put a fence around the property except for one of the sides. They told me that the reason why is because the neighbour didn't allow them to change the old one for a new one. My problem is that on my side the fence has several rusty long nails coming out and 4 concrete columns that are very sharp. I have small kids and I really don't think that that is safe apart that it looks terrible. Is there anything that I can do to make my neighbour allow me to change it? Shouldn't the developers have done something to it anyway? Please help!! Thank you!!

    Either offer to replace the fence at your cost or put your own fence up in front of the other one.

    Just put a new fence up alongside their one, nothing stopping you from doing this.

    As above, your own fence tight upto the other fence, do not leave a big gap.
    You neighbours are then not allowed to paint, stain, lean anything on, attach anything to or do anything to your fence.

    Your neighbours are likely to later on remove their fence.

    agree with above, always worth mentioning it politely and friendly to the neighbours.
    the ball is in their court then if they want to be arsey about it.
    However you take away any reason why they might moan later that way (i.e. snooty cow whacked a fence up without so much as a by your leave........)

    Which side? My mom was recently told to replace a fence the neighbour had broken as apparently, as it was the left hand side (when standing by the house and facing out) it was her responsibility and classed as her property...
  • It's a common misconception that the left hand fence (when viewed from the property) is the responsibility of the householder.
    The only way to prove who owns and is responsible for a fence is if it's marked or stated on the property deeds.

    If there is any doubt as to ownership, then it's probably best to come to an arrangement with your neighbour over the cost of replacing it or leave it where it is and as suggested above, put a new one up on your side.
