You find it odd, I'm wanting to be reimbursed for my losses for a breach of contract and refusing to give me a refund? So you would walk away with your losses unaccounted for. Haha you're funny :doh: ...moving on....
So maybe a laptop on top is being a bit too optimistic, but I was only given a refund from the bank. None of my other losses were accounted for, so use a brain and go figure why i wouldnt just sign the forms.
The card getting declined when you don't have any cash and you've scanned all your items with people waiting behind you is indeed embarrasing :doh:
I've been in talks with Dell's executive support team so all other options have been exhausted.

Someones free to correct me if i'm wrong but afaik, signing those forms with the bank were only giving them authorisation to report a crime to the police/pass your details on. It would NOT affect your ability to chase Dell for your losses.
Did they actually cancel the whole order or put it on hold/pass it to a department to be dealt with manually? Do you have this in writing from them that they cancelled it and then (for some reason) put through the order again manually? Basically what did dell say when you questioned why they tried to retake the amount? Or did you tell them you wanted to cancel before they tried to take the money again?You keep using that word. You just need to list your actual financial losses that were caused, and bear in mind that you should always attempt to mitigate losses.
I've seen in small claims courts where the claimant has put something like "miscellaneous phone calls and incidentals" and a figure of 15 pounds or so, and that would probably be considered as a reasonable without reams of paperwork.
For larger claims, in my experience the judge would want to see evidence of those actual costs.0 -

Is it really that embarrassing to have a card declined in front of strangers you will never ever see again? Most of them couldn't give a monkeys about who you are or how much money you have got or anything else about you for that matter.

To clear things up. There is proof the order was cancelled.
The laptop never arrived to me, and if it wasn't because of my card being declined it probably would have gone without notice for quite some time.
To put it into perspective it is like Dell stealing your money, and then after being caught saying, "Oh, we're sorry. You caught us. Have it back". Except they won't let me have it back.
The additional charges I incurred were that of using my phone every day for almost 2 weeks. The bank agreed to cancel any interest charges if the visa charge-back forms were signed. However, at the end of the forms as previously stated, they would not let me know the outcome of the investigation, and therefore the whole case would have been closed.
Where I buy my groceries from the people do know me and it was embarrassing having them remove everything I had taken from the shelves to be put back there.
I thought people here would be civil, or at least, try to understand. I was wrong. Quite the opposite.
I'll be getting legal advice and see where I actually stand. Most of you have wasted your time posting this thread because there is little to no meaning in your posts. <:T

December 28th, 2012. I purchased another laptop from the Dell outlet website. It appeared that everything was running smoothly, until after several days I couldn't see the order progressing. Soon after, Dell had cancelled the order (confirmed) due to my bank not releasing the money for security reasons.
So did you get the security check call to see if it was a genuine transaction?

28 dec to 8th Jan is only 11 days. Less the several days before you found out money not taken.Dell had made a new order without my knowledge, and soon after charged my account, again without my knowledge. I found out, very inconveniently, when my card got declined after needing to buy some groceries. I checked my statement online and I could see Dell had charged my account causing me to go well into my overdraft.
So where did the £1600 go in that week? That was set asside to buy the computer,The computer never came. After a week Halifax had refunded me through visa chargeback.

That sounds more like you were claiming fraud. From that as that is the wording on a fraud declaration and not a dispute one.
Which would not be required for non reciept.Therefore, because I wouldn't receive any compensation from the losses occurred from Dell I have decided it would be best to pursue Dell in the small claims court instead.
Chargebacks are only to put you back in the same position as before. NOT cover compensation.Ideally, the total I want would be a full refund + the laptop, or of similar specification as compensation. If not, the value of the laptop on top of a full refund. Am I sounding over enthusiastic?
