Advice on potential ebid fraud

Hi,

Just wanting some advice , I wont put details that will give information about the person selling in detail as I dont want to be accusing someone falsely but am just wanting to know my options if this goes bad.

I have ordered a mobile from ebid and paid via paypal initially communications with the seller were fine, they are fairly new to ebid but they have had some positive feedback.

However after paying communications have stopped, the item has been marked as posted but when asked for more information they havent responded. It is still possible the item is delayed in the post hence why at the moment I am just checking what to do if things go wrong.

The reason I am concerned is after the purchase I did a search and found they have been kicked off ebay for a fair bit of negative feedback (not all about 40 out of 300+) but its all fairly recent and all about items not being received. Also I found a news article on a website that this person has been previously fined for doing this

So my question is assuming this item does not arrive whats my best course, paypal, ebid the police or all of the above?

    Raise a dispute with PayPal if it comes to it.

    PayPal is your friend. Just ensure you comply with the time constraints to ensure you are not out of time. You may have to wait a little longer to have the funds returned, but the Resolution Center will make the process easy.

    Well done for using a sensible payment method!

    Haha, sensible payment method? Seriously?

    If it is a scam the op won't get the money back via PayPal.

    The paypal account would have been cleared straight away, and for
    paypal will only refund problems outside of eBay if there are funds in
    the seller's account.

    I think Paypal will pay even if the Seller not got any money in he's or her's account otherwise whats the point of paying though Paypal if you ain't got no protection.

    I know its not the same as the OP but i had a claim against me when i sold a mobile phone the person said it was faulty and i said it wasn't which it wasn't they were pulling a fast one

    After about 2 weeks Paypal gave the person there money back and sent me a message saying it was no ones fault and that they refunded the buyer but they will not be taking the money from me
    I didn't have any funds in my account at the time.

    Read paypals terms, see how well you are protected in non ebay transactions.

    It's all in there, the gist is, if they can't recover the funds from the seller, from either their paypal balance or from a registered card, then the buyer can go and whistle for a refund

    I just read the terms and conditions and can't find nothing saying they will not refund if a seller doesn't have funds.
