Intresting question. At what point does it stop being discrimination and instead company policy.
I can understand that saying no to two people of the same sex is discriminory, but does saying no to a party of 4 or 6 mean it is discriminaory?
Prehaps it's company policy not to have parties of the same sex as they are usually on a bender such as a hen night or stag do or party cruise and previous experience shows that those groups cost the hotel money and bad reputation.
Although I believe what the hotel is doing is discriminatory, it is not malicious nor against the spirit of the discrimination law.0 -
Doesn't matter, it's still discrimination based on gender (and indirectly it would class as discrimination based on sexual orientation, since the policy would forbid gay couples from holidaying together)
If you actually read your link you will see discrimination is when they are treated differently on account of their gender. It's been this way for 20+ years, I remember friends booking under mixed names for lads getaways. Parks/resorts do it as single-sex groups are a liability and more trouble than they're worth - booze and bravado in front of friends makes for a lot of theft, damage and fights (yep, both sexes) as opposed to mixed couples.0

Not to say the number of other guests that are deterred from revisiting the establishment. I, for one, would avoid a hotel which accepts single-sex groups.0

the booking was for £80, money taken by last minute.com. they have offered £40 as a refund.

In which case you need to insist that they refund you the whole amount.
There may be an issue here with them being an agency - maybe someone else can advise on whether to keep hassling lastminute.com or the hotel directly.0 -
OP Call last minute, the only right thing to do here is they refund the money in full.
The hotel might have messed up by offering the refund this way, they should have instructed lastminute.com to cancel the booking and refund.0
