Statatory Redundancy payment help

Options
Hi All,
I was made redundant 3 weeks ago as the company i was employed with for 10 years went into administration and they have now ceased trading.
Aswell as being owed Statatory redundancy pay iam also owed my last 3 weeks wages as i was paid weekly aswell as 6 days holiday pay.
I attended the meeting that the Administrators called for our employees and there i received the RP1 claim form and i sent it off to Birmingham that very same day 3 weeks ago.
I have never been in this situation before and i went onto the administrators website dealing with this and there is nothing on there regarding redundancy pay, so basically has anybody have any idea how long it takes for all that's owed to me to go into my bank as i had to include my bank details etc on the RP1 form.
will it just appear in my bank or will i receive a letter notifying me it's being paid on a certain date??

Many Thanks

Aron

When you say you sent it to Birmingham, do you mean straight to The Insolvency Service, Redundancy Payments or is that where the Administrators are also based?

The RP1 needed to be returned to the Administrators for them to do their bit and then electronically forward the information to The Insolvency Service for processing and payment into the bank account you gave them.

If you sent it straight to The Insolvency Service it may delay your claim and you need to speak to the Administrators to confirm if they have been notified by The Insolvency Service that you sent your form direct.

As to how long payment will take, typically 4 -6 weeks, but you can imagine with claims from employees of the likes of Comet and HMV they are rather busy, not to mention the 30% cut in staff numbers.
  • Yes i posted it straight to the insolvency service as there address was on the RP1 Form.

Oh dear, either in a covering letter or the back of the form it should have stated that the form should have been returned to the Administrators, never mind, you better get onto the Administrators ASAP.

As to whether you will receive a letter (or an email) first or the money into your account it is anybody's guess.

There is a phone number and an e-mail address for the Redundancy Service in Birmingham in the link below. The information also refers to sending the claim directly to them.

I suggest that you phone them during office hours, with your NI number and/or your claim reference number, assuming your claim has been logged on the system they should be able to tell you where they are up to with it.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

When this happened with my friend, the redundancy claim papers had two boxes on the back. The left hand box was left blank and a note above the boxes said that if the left box was blank, the papers should be sent to the other address in the right hand box in Birmingham.

My friend rang the Administrators to double check this and was told "Sorry...we forgot to place our address stamp in the left hand box!"

So a good number of the 100 employees affected will be sending their papers to Birmingham by mistake.
