Can I reiterate that you should not pay the parking company if they are writing to you, can you confirm if your hire came through an address in France or the UK. The reason I'm saying this if they deem an address abroad is not serviceable they may go back to the hire company. Actually, I have heard nothing yet directly from the parking company, only the hire company forwarding their communication and confirmation of their own deduction.
Hire was through French address. In conjunction with the Credit Card Co I have asked them to investigate and reimburse the £35, and stopped the card and to pre-empt any further raids!!0 -
Slithy, thx for your helpful comments. I have said all that to the car hire co who simply tell me I am wrong and keep reiterating that the law "now allows the PPCs to sue me"
They also tell me that sending a letter to me in France dated 30th Jan and taking payment from me on 31st constitutes reasonable endeavours to notify me!!0 -
They are not supposed to pass on letters to you, what they are supposed to do according to the bvrla is give your name and address to the parking company on a return form that is the letter to registered keeper, the parking company even supplies an sae or free post address to send it I think.
This should cost the hire company nothing, adding £35 or anything is a breach of contract. I'd put a few pounds on the parking company trying to be cute here and to get the hire company to pay. I don't know how French credit cards work so if cancelling cards stops payment that's fine, but credit cards here can still be debited even if the account is closed sometimes. So bare it mind.

You need to include the relevant part of the T&Cs that they are in breach of, what you've highlighted already. Also outline how much you are going to claim.
£35.00 for deduction
£30.00 for the claim
£150.00 for flights etc to be at a court

MUCH more urgent is the letter you need to write to the PPC. See my reply on the other thread you posted on.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
