If they say the other driver was speeding it might influence the portion of liability.

Okay. Do you think hubby would be better off not contesting this in order for a quicker solution.
Would he just have to pay out the £250 excess & that is it?
Also hubby wants to know as current Insurers are dealing with this accident, when he tells them he is not renewing with them in March would this affect anything? IE would they say he can't change due to this ongoing case or is it fine for him to change in March? Obviously we know they will probably try to change his mind but can they insist he stays with them because of this case?

Sorry, OP, but without witnesses I don't think your husband can escape full blame. In the absence of any other evidence, the basic fact is that he has pulled out from a minor road and crossed the path of an oncoming car.0

Deborah have a look at the two streetview images I've linked to, if you picture where the damage is to both cars (Drawing a basic picture with boxes for cars helps). Bearing in mind the guy on the main road has the right of way can you see why the accident will be deemed your husband's fault.
I'm guessing the third party swerved into the left hand lane.
If the other party had just emerged from the factory you might have some argument as to them bearing a portion of the blame although your husband would still bear the brunt of the liability.0
