I will apologise. I seems you have got this one partly right. Lets face it, the trend had to reverse sometime.
It is allowed to be used for income tests, except for those who are pensioners, for whom it is still not included as income for the purpose of Council Tax Reduction Schemes.

But they can get access to some of those 'public funds' if they have a partner who got ILR (Indefiante Leave to Remain) or UK citizenship, as long as the claim is in their partners name. i.e. working tax credits. This means that even the children who also have 'no access to public funds' stamped in their passport, can have public funds too i.e. child benefit, child tax credits, housing benefit, council tax benefit etc.
So 'no access to public funds' doesn't mean no access to any welfare payments or the NHS, council houses, schools.
Just out of interest, Cameron has shut down a load of routes to UK citizenship for the low skilled, to protect the UKs welfare state; including the new visas that Labour invented; over the last decade; for the low skilled (future Labour voters) to get to the UK. These are some of the low skilled visas Cameron has closed.- PSW visa
- The '14 years an illegal and never got caught; have a British passport' visa
- The Tier 1 general visa
- The Tier 2 ICT visa route to UK citizenship
- The ILE visa
- Elderly parent visa
- Discretionary visa under human rights with instant access to all welfare payments
- Chen EU route to UK citizenship

The questions do need to be relevant, appropriate & reflect rights of both sides.
Like asking someone (in the very first post) if they have a motability car, meaning a portion of their DLA is not available to them as cash, so a new law that allows the local authority to have regard to DLA (cash) in their decision making process means they may decide that the cash is unavailable to the applicant and make their award accordingly.

Not everyone chooses to purchase a car through motability. Some use the money to finance their own vehicle, others use the money to cover increased travel costs such as taxi's. I hope the councils are aware of this.0

I'm sure they do and it is probably why they are asking the question rather than just assuming DLA was available as cash.0 -

The assessment of DLA has been made for its purpose.0 -
I attended, as "a friend" last week, when my mate had an ATOS Doctor's visit for DLA, which she's received for several years. It lasted about one and a half hours, and she answered everything truthfully, as she has done on countless forms before.
I showed the doctor the safety rails in various rooms, and the raised toilet and guard round it, and bath lift etc, and I'd arranged the meds, repeat prescription, hospital letters, so that these could be noted. My friend was asked about difficulties at night using the loo, and wasn't concerned answering.
I only spoke when my friend dried up and started crying when she was asked the nature of her pain, and then pointed out that she'd mentioned to me on numerous occasions, that it was a stabbing pain, and then worsened. This gave my friend confidence to expand fully on the pain, and how it restricted her.
When the doctor left, we breathed a sigh of relief, but as my friend said "I don't care how many questions they have to ask, if it means they continue with my DLA".
And that's the point, isn't it. If this allowance was anyone's for the asking, posters would, quite rightly, be up in arms. It may seem embarrassing to have to discuss the number of times you need help in the night getting on and off the toilet, but as "help both day and night" is needed for HRC to be awarded, then that's what you have to do.
