Ok, let me clarify.
Other than a CP12, the landlord does not need to be able to prove anything e.g. that the item has been serviced.
The safe escape of fumes via a flue (where required) is part of the CP12 checks.
Cleaning is the requirement of the tenant in most tenancy agreements.0 -
Yes I agree with you in the case of a hob, it would be something the visiting gas engineer should point out vigorously.
But in the case of a boiler or fire, from what I've read and been told by people in a better position than me, is that servicing is part of the maintenance regimen and ignorance is not an excuse in court.
To be honest I think the Gas Safe Regulations need clarifying in greater detail with regard to regular servicing of gas appliances.
Do LL's need to prove regular maintenance? I think that needs a legal answer.0 -
Technically on an LL check the appliance does dot have to be serviced, but by doing the check, the operative will be making his own assessment as to the condition of the appliance.
If he deems the appliance unsafe due to lack of servicing, then it will be turned off with a minimum of an AR issued, with the tenants permission.
I always service an appliance, not a cooker or gas hob though, when carrying out a LL check, as I charge the same whether it is serviced or not.0 -
It's all on the HSE's web site -You must ensure that gas appliances and flues are maintained in a safe condition and that regular gas safety checks are completed. The requirement for landlords to provide domestic gas maintenance is distinct from the requirement for keeping gas safety records.There are no formal requirements for you to keep maintenance records. But you will need to be able to show, if asked, that you have regularly maintained the flues and appliances and completed required repairs. You do not have to provide records for tenants
As HSE will likely do the prosecuting, it's as well to know the requirements.0
