gas safety check

hi im in rented accomadation and have never in 3 years been late paying i have reciepts for every single month i have all the reciepts for the gas electricty water council tax etc... my problem is my gas check was due in november 2012 but still hasnt been done i have been in the estate agents numerous times and all i get is i will ring to let you know when they are coming out but never hear nothing is there anything i can do i have told them if anything goes wrong i will hold them responsable as there are 2 kids here as well any help please sorry about the spelling

    Tell them you will report it to Gas Safe and/or the HSE.

    It is a legal requirement for the property to have an annual landlord certification with a copy given to you, one kept by the engineer and another that the letting agent/landlord keeps.

    No ifs, no buts, it must be done. They are totally responsible for your safety.

    Give them one last chance to get it sorted.

  • so it is a full year since and they are aware? btw it wouldn't matter if you hadn't paid things they are required by law to do gas checks

  • As G4Y said, ring the agents and tell them you have or will be contacting Gas Safe, you could also ring your local council and speak to their housing dept. They will not be happy to hear this LL and agent are dragging their feet.

    Remind the LL that non-supply is punishable by an unlimited fine and a potential prison sentence.

    If you think there is anything that might be dangerous, you could always get it checked out yourself by an appropiately authorised gas engineer.

    It's all very well holding some estate agency responsible, but that won't help you if you end up habing to bury your two most important things in your life! :eek:

    If no immediate, obvious danger, then call the letting agency on Monday 9am. Remind them you've already contacted them numerous times about getting a CP12. Tell them you want a response by 10am and you won't be very happy if you have to call them back at 10am to be provided with it.

    A gentle hint to the letting agents that tenants can report properties without a Landlord's Gas Safety Record direct to the Health and Safety Executive might persuade them to do their job properly.

    A LGSR only confirms that gas appliances are safe to use on the day it is issued - anything could go wrong a day or a week later.

    However, the landlord also has a legal obligation to maintain any gas appliances in the property which belong to him (basically, they should be serviced regularly), so it would make economical sense to have both the annual gas inspection and the servicing done at the same time.

    There is a legal requirement for landlords to maintain all gas appliances, part of that maintenance is an annual safety inspection.
    (2) Every landlord shall ensure that there is maintained in a safe condition—
    (a)any relevant gas fitting; and
    (b)any flue which serves any relevant gas fitting,
    so as to prevent the risk of injury to any person in lawful occupation or relevant premises.

    Hobs, although its impossible for a LL to police, should be cleaned of burnt food/liquids otherwise they start to produce CO.

    I can't personally see a LL getting away with not ever servicing an appliance.
