    Apologies for resurecting an old thread but I've just had the same JSA refusal due to lack of NI contributions. I have paid NI for the last 2 1/2 years albeit with different employers on temporary contracts but I did have a short period of previous JSA contribution claim in Dec 2010/Jan 11. I suspect this period caused them to refuse the claim.

    I suspect HMRC will have screwed up as it took me 7 months to reclaim over £1000 of overpaid tax in 2010-11 so I expect they have also screwed up my NI records.

    EDIT: I did however read somewhere that ANY gap, however small, in NI contributions in the previous two calendar years will cause a new JSA contribution claim to be turned down. If that is true it's liitle wonder it pays not to work as I could have claimed 26 weeks back in 2010 and now apparently I have shot myself in the foot by accepting a job as soon as I could and now I'm unable to claim 2 1/2 years later.

    If true it's no wonder there is so much welfare abuse.
    If the ball had gone in the net it would have been a goal.
    If my Auntie had been a man she'd have been my Uncle.

    Don't make mistake of turning on others just because there is a problem with your claim or you didn't know system or didn't check.

    I'm not turning on others. Just pointing out ..if true.. a massive potential abuse hole in the system... there are just as many in tax system and they too need closing.

    It's also unfair to genuine claimants if you have to wait up to 3 years between claims.. again IF true.

    Having been in work for 35 years I don't know the system
    and judging by some of the comments on here and other threads neither do some of those who administer it.

    Thank you for this (your a legend for this link) - couldn't agree more with your comment

    Having sat in a jobcentre recently where I heard an advisor 'playing god' with someone's benefits it could have bordered on intimidation never mind flawed, had my surname spelt wrong, was given the wrong form to respond to a sanction, I might just do as you suggest

    Doing so will likely result in a sanction.
    Under no circumstances be the least creative, or do anything other than precisely what is specified. If there is ambiguity, get it clarified first.
    The new sanctions regime is harsh.

    The risk of being sanctioned - even for a very short period as you know you can cope with the financial loss is largely not the point.
    It's the fact that that sanction may then cause further escalation in subsequent sanction periods, up to and including 3 years.

    Agreed. I dont think they appreciate the concept of irony.:p

    I'll button my lip until I get the claim investigated and hopefully sorted.
