Parking Fine from CMS UK Ltd

I was parked in total fitness, Altrincham last night and after a nice evening out with friends returned to get my car at 10:45pm only to find the car park was all locked up with my car inside and no way of getting in.
Security was no-where to be seen either.
So I had to taxi home then taxi back this morning to retrieve my car. What a surprise (not) to find an "overnight parking fine" on my winscreeen. £100 or £60 if I pay in 14 days.
Can anyone advise if this is enforceable ? The security guard on site this morning said I as lucky not to have been clamped but I will need to pay it as it's a private carpark.

  • The security guard was talking out of his a***, but then security guards never were the brightest bunch. Clamping is illegal, so that would never have happened.

    Also illegal is blocking your car, which is what has happened. Although in your case, it was legal, as there is an exemption for barriers like this.

    Immaterial of all that, the parking "fine" (did they really call it a fine) is unenforceable. Simply ignore it.

  • Hi, I'm renting a flat from the estate agency and in my rental agreement is clearly stated that I have an allocated parking space. All parking spaces have asigned numbers so people that are living in this block of flats know where to park. When we were receive the keys to this apartment the estate agency newer said anything about parking permits to park at the property car park. Couple days after I moved in to the apartment I received first parking ticket form CMS UK Ltd. I have 3 all together and today I received a Reminder Notice from CMS UK Ltd for one ticket and it is saying that I need to pay £90, if I dont pay the penalty will rise to £140.
    Do you know if it safe to ignore them? Thanks in advance

    Totally safe.

    If your space is included in your agreement, your right to "quiet enjoyment" applies there as much as it does in your home. So as well as ignoring CMS, you are fully entitled to instruct your managing agent to stop CMS operating on your space.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It does help to start a new thread.

    Despite it being the same company, the idea is to follow through an individual's progess through the letter chain if they need. If you get a couple of other people posting, it gets confusing.

    Also, advice has changed over time as situations change, so bumping an age-old thread risks people picking-up on supersceeded advice.
  • i parked at Robin park to enquire about times and prices of films. i parked in a disabled bay but my friend forgot to display his ticket. however when trying to get onto CMS website my computer does not allow access to this site as it shoes by red dot that it is unsafe to do so. therefore i can not appeal. however i have read the threads relating to this company and want to know, is this company for real or a scam and what do i do regarding the parking fine?
